44-1120. (a) This act and the amendments made by this act shall take effect on the effective date of this act, except that, with respect to any employee who is subject to a collective bargaining agreement, such amendments shall not apply until the termination of such collective bargaining agreement or January 1, 1990, whichever occurs first, if such collective bargaining agreement: (1) Is in effect prior to the effective date of this act; (2) terminates on or after the effective date of this act; (3) has any provision which was entered into by a labor organization (as defined by section 6(d)(4) of the Fair Labor Standards Act of 1938 (29 U.S.C. 206(d)(4)); and (4) contains any provision that would be superseded by such amendments, but for the operation of this section. (b) This section shall be a part of and supplemental to the Kansas age discrimination in employment act. |
