Short Title

Amending the Kansas life and health guaranty association act to include health maintenance organizations as member insurers and broadening the assessment base for long-term care insurance insolvencies.

The Chair opened the hearing on HB2810, Assistant Revisor Ma gave a detailed overview of the bill and stood for questions. (Attachment 1)

Proponent, in-person testimony was presented by:

  • Alex Young, Regional Director of American Council of Life Insurers (ACLI).    ACLI  maintains changes outlined in HB2810 will help ensure that the Kansas Life and Health Insurance Guaranty Association, which was created to protect consumers and act as a safety net in the event of an insurer insolvency.  (Attachment 2).
  • Andrew Wiens, Executive Director, Kansas Employers for Affordable Healthcare (KEAH).   KEAH supports the splitting of future long-term care insurance related assessments equally between life and health insurance industries; protecting employees and employers in the event  of an insurer insolvency.   (Attachment 3).
  • Eric Turek, Director of Government and Public Affairs,  Kansas Insurance Department (KID), disclosed updates were requested by the American Council of Life Insurers and are appropriate to expand the association membership, amend assessments for long-term care insurance insolvencies, and clarify components relative to health maintenance organizations. Additionally, the KID requested language that will allow the Commissioner to remove approved board members for inefficiency neglect of duty, or malfeasance. (Attachment 4).
