HB 2328 would enact the new crime of abusing toxic vapors defined as knowingly possessing, buying, using, smelling, or inhaling the fumes of toxic vapors or knowingly aiding another to use such a substance for the purpose of causing a condition of euphoria, excitement, exhilaration, or dulled senses of the nervous system.

The crime of abusing toxic vapors would be a class B nonperson misdemeanor. In addition to any sentence or fine the abuser will be ordered to enroll in and successfully complete an alcohol and drug safety action education program or treatment program.

In addition, the bill authorizes the court to fine a juvenile offender in the amount of $200 but not more than $500 when a juvenile offender's adjudication is based on a violation of the law prohibiting the possession of depressants, stimulants, hallucinogenic drugs, marijuana, or its synthetic equivalents.

The fiscal note was not available when the bill was passed.

The House Committee of the Whole added the provision regarding possession by a juvenile offender of prohibited drugs.
