SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2224

Brief (1)



HB 2224 would modify the procedure for approval of a tribal gaming compact. The existing statute (KSA 46-2302) authorizes the Legislature to approve any such gaming compact after it has been negotiated by the Governor and the tribe. The statute also authorizes the Legislative Coordinating Council to approve a compact, but only if the Legislature is not in session.



HB 2224 would delete the authority of the Legislative Coordinating Council to approve a compact and provide instead that a special session of the Legislature could be called to approve or disapprove a proposed compact. Each house of the Legislature would vote on a resolution approving the proposed compact within five days after the introduction of the resolution.





Background



The sponsor of the bill, Representative Findley, stated that the bill is to ensure that all members of the Legislature are allowed to vote on gaming compacts. There was no testimony in opposition to the bill.



The fiscal note prepared by the Division of the Budget states that the estimated cost for a two-day special session is $78,778 from the State General Fund. Each additional day would cost $32,042.
