SESSION OF 2001

SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2136

As Amended by Senate Committee on
Judiciary

Brief (1)

HB 2136 amends the law regarding the computation of a defendant's criminal history for the crime of involuntary manslaughter while driving under the influence of alcohol or drugs (DUI). The change adds the provision that a DUI conviction of a law of another state, ordinance of a city, or resolution of a county will count as one person felony for criminal history scoring.

The Senate Committee deleted the House Committee amendment which would have discounted or decayed a DUI conviction after a period of ten years with no intervening violations.

Background

A conferee from the District Attorney's Office in Hutchinson appeared in support of the bill, as drafted.

The fiscal note indicates there would be negligible additional costs.
