Brief (1)



HB 2052 repeals KSA 12-1769, a statute which authorizes city and school district cooperation in acquiring a site and constructing and equipping a community building. Subject to an election, the city and school district may issue general obligation bonds to support the project.





Background



HB 2052 was requested by the State Board of Education. State Board staff reported that they knew of no instance in which this law, enacted in 1949 and updated in 1965, had been used. State Board staff explained that, about two years ago, one school district was examining the potential of this law and raised some questions regarding it, but took no action. During review, a question arose as to whether the bond and interest state aid program might be applicable to bond issues under this statute. To ensure that this aid program was not applicable, in 1999 and 2000, the Legislature incorporated a provision in the Department of Education's appropriation to specify that bond and interest state aid payments could be made only for bond obligations approved by the voters under KSA 72-6761, the general bond law applicable only to school districts. Repeal of KSA 12-1769 would resolve this issue.



The House Committee on Education recommended that the bill be placed on the Consent Calendar.



HB 2052 has no direct fiscal impact.
