SUBSTITUTE FOR SENATE BILL NO. 255

Brief (1)



Sub. for SB 255 would subject any person or custom blender of fertilizer to a civil penalty of not more than $5,000 per violation for violations of any provision of the Kansas Commercial Fertilizer law or any rules and regulations adopted relating to fertilizer regulation. The bill would provide that each day of continuing violation would be a separate violation. These civil penalties would be subject to review in accordance with the Act for Judicial Review and Civil Enforcement of Agency Actions.





Background



The substitute bill was adopted in order to provide for civil penalties for those who violate provision of the Kansas Commercial Fertilizer Law.
