Brief (1)



HB 2894 would expand the crime of unlawful sexual relations to include the situation when the offender is a teacher and engages in consensual sexual intercourse, lewd fondling, or touching or sodomy and the victim is 16 or 17 years of age and a student enrolled at the school where the offender teaches.



A teacher would include teachers, supervisors, principals, superintendents, and any other employee who is required to have a teacher's or school administrator's certificate in any public or accredited private school.





Background



The two primary sponsors of the bill testified in favor of the measure. In addition, the Johnson County District Attorney spoke in support of the bill.



The fiscal note indicates that the Sentencing Commission would need an additional data entry position which would require $23,106 of which $20,795 would be from the State General Fund. The Department of Corrections would need $5,500 per capita for any inmate population increase. There could be increased field supervision and community corrections' caseloads which would cost $2,200 and $2,653 per capita, respectively. If additional facility space were needed, there would be one time construction and equipment costs.
