SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2861

Brief (1)



HB 2861 would amend the section of law dealing with waste tires to include in the definition of "used tire" those tires which remain on wheels removed from vehicles or aircraft and also those which have been determined to have value in accordance with rules and regulations at waste tire collection centers. The definition of "waste tire" would be amended to include whole tires that have been removed from wheels following a period of use or remain on wheels removed from vehicles or aircraft following a period of use.



The bill also would permit moneys in the Waste Tire Management Fund to be used to abate waste tires accumulated by a city or county as a result of a temporary waste tire amnesty collection program authorized by the Department of Health and Environment (KDHE) before July 1, 2001. No more than one amnesty program could be conducted by a city or county after January of 1999.



The bill also would amend a section of current law to permit the Secretary of KDHE to authorize the use of waste tires which have been cut into two or more parts for use as daily cover material for a landfill.



In addition, the bill would amend several sections of law dealing with hazardous wastes. With respect to this portion of the bill, the definition of "hazardous waste disposal facility" would be redefined as "hazardous waste facility." The new definition of "hazardous waste facility" would be a facility or part of a facility:









The bill would change references in other sections of law to "hazardous waste facilities."



Other amendments in the bill delete obsolete language.





Background



This bill was introduced at the request of a spokesperson for KDHE. At the hearing on the bill, the only conferee was a spokesperson for KDHE. The spokesperson stated that the bill was drafted by the Department to update the waste tire statutes with respect to certain obsolete grant provisions; clarify KDHE's regulatory authority related to accumulations of tires on rims; and confirm that KDHE can use the Waste Tire Management Fund to directly contract for the disposal of waste tires collected through county or city coordinated amnesty collection programs.



The Senate Committee on Energy and Natural Resources amended the bill to allow waste tires cut into two or more parts to be used as daily cover material for a landfill. The Committee also amended the bill to add the provisions of SB 658, which defines the term "hazardous waste facility," from the current defined term"hazardous waste disposal facility."
