SUPPLEMENTAL NOTE ON SENATE BILL NO. 526

Brief (1)



SB 526 gives the Kansas National Guard the authority to expend forfeiture funds that the agency has acquired and maintained as a result of property seizures associated with anti-drug operations conducted in conjunction with law enforcement agencies. Current law allows the agency to receive moneys and property seized, but does not allow the agency to make expenditures from any seized fund accounts.





Background



The bill was supported by the Adjutant General and the Kansas Bureau of Investigation.



The Adjutant General indicates that the agency currently has $20,000 in an asset forfeiture fund that could be used to enhance the agency's operations. The Adjutant General also states that it would like to use these funds to purchase additional equipment that would enhance the ability of the agency to support other law enforcement agencies in statewide anti-drug operations.



The bill has no fiscal impact on the state other than allowing the Adjutant General to spend moneys that are currently available.
