SESSION OF 1999

SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2154

As Recommended by House Committee on

Judiciary

Brief(1)

H.B. 2154 amends the law regarding self proved wills to allow for an out-of-state notarization of the affidavit of a self proved will for a Kansas resident.

Background

Representatives of the Kansas Bar Association and the Judicial Council expressed support for the bill. Examples of the need for the bill include the situation in which a Kansas resident is admitted to a hospital in Missouri and wishes to make a will. Under current law, a Kansas notary public cannot notarize such a document while the person is in another state.

The fiscal note indicates no fiscal impact.
