Brief(1)



H.B. 2831 would amend the Workers Compensation Act to clarify that an owner operator of a motor vehicle leased or contracted to a licensed motor carrier would not be considered a contractor or employee of the licensed motor carrier if the owner operator is covered by occupational accident insurance and is not considered an employee under the Federal Insurance Contribution Act, the Federal Social Security Act, the Federal Unemployment Tax Act, and the federal law prescribing income tax withholding.



Under the above set of circumstances, the licensed motor carrier may obtain workers compensation insurance for the owner operator and can charge back the premium to the owner operator.



The bill is placed on the consent calendar.
