H.B. 2367 would require a life sentence for those persons who manufacture, sell, offer for sale, cultivate, deliver or distribute, prescribe, administer, dispense, or compound certain drugs in type and amount established in the bill.

Any reduction in sentence could only be given if the prosecutor certifies to the court that the defendant has provided substantial assistance to the state.

The fiscal note on the bill as drafted indicates an impact on the prison population that might require an additional 2,441 beds. Because of certain unknown factors and variables used to estimate the need for bedspace, the figure could be as low as 375 beds by 2007. Another scenario estimates a need for 1,224 additional beds by 2007.
