SESSION OF 1998

SUPPLEMENTAL NOTE ON SENATE BILL NO. 532

As Recommended by Senate Committee on

Judiciary

Brief(1)

S.B. 532 amends a criminal procedure law dealing with post-release supervision to provide that an offender convicted of more than one offense shall be required to serve the longest period of post-release supervision available for any crime for which there was a conviction. Current law provides that the post-release supervision time required shall be for the crime with the highest severity level.

Background

The bill was supported by the Department of Corrections which noted that a 60-month post-release period is provided for persons whose crime involved sexual violence or was sexually motivated. It is possible for an inmate under the current law who has been convicted of a sexually motivated offense as well as another higher severity level crime to be given a 36-month period of post-release supervision since this amount of time is provided for the higher severity level crimes not 60 months.

The bill has no fiscal impact.
