S.B. 399 amends a portion of the Adult Care Home Licensure Act (K.S.A. 1997 Supp. 39-970). The 1997 Legislature passed H.B. 2278 which prohibited adult care homes from allowing persons with a felony conviction for crimes against persons, sex offenses, or crimes affecting family relationships and children from working in an adult care home. The Senate Committee amended S.B. 399 to broaden its application beyond the Kansas Veterans Home so that it would allow for the use of inmate labor at the Kansas Soldiers' Home, Larned State Hospital, and Osawatomie State Hospital as well. The bill exempts persons in the custody of the Secretary of Corrections, and providing services to such state institutions, from the prohibitions contained in K.S.A. 1997 Supp. 39-970. Such services must be provided under direct supervision, in nonpatient areas, on the grounds, or in other areas designated by the Superintendent of the institution.





Background



The bill was recommended by the 1997 interim Legislative Budget Committee. It was supported by the Department of Corrections, Social and Rehabilitation Services, and the Kansas Commission on Veterans Affairs.



The House Appropriations Committee amendments were technical in nature and added Larned State Hospital and Osawatomie State Hospital to the bill title.



The fiscal note indicates the bill would have no fiscal impact.
