Mr. Speaker: I vote ``no'' on HB 3021 because it attempts to relieve the State of its
responsibility in the environmental remediation of the proposed Oz Project, near DeSoto.
As a result, there would be no one held accountable should health or environmental prob-
lems occur in the future. Immunity provisions, such as this, put all Kansans at risk. Because
of the broad immunity proposed in this bill, the State could be relieved of similar environ-
mental remediation responsibilities on any project, anywhere in Kansas. Such immunity
laws put Kansans and generations of future Kansans at risk, protecting only those who profit
at the expense of the safety and accountability of our constituents.--Dale Swenson
Mr. Speaker: I vote NO on HB 3021. The state of Kansas cannot deny responsibility
for environmental cleanup under federal CERCLA law. This bill places Kansas as a re-
sponsible party and puts the people of our state and its ``deep pocket'' into a position of
liability to pay for the clean up of a federal hazardous waste site. To the extent that this bill
denies liability on the part of our environmental agency to our own citizens, HB 3021 is
bad policy. If our state environmental agency is not responsible for environmental cleanup,
who is? Whether the goal is to shirk responsibility to our own citizens or pretend that we
are creating safety from federal law, this bill is wrong and I vote no.--Marti Crow, Annie

Mr. Speaker: On behalf of the citizens of DeSoto and around the Sunflower Army
Ammunition Plant, I would like to thank everyone for voting for this Bill for your concerns,
for the health and safety of these families. The State of Kansas asks to get involved with this
project, I repeat asks to be involved with this project. They are not being forced to get
involved with this 9000 acres of polluted land. However now that the State wants to be
involved, we are going to release them from all liability on this project. This is very com-
forting for the people who live around this site. For these reasons, Mr. Speaker, I vote No

approve any capital improvement project for the construction or expansion of any prison or
any other correctional facility for the department of corrections for the purposes of subsec-
tion (b) of K.S.A. 74-8905 and amendments thereto and the authorization of the issuance
of bonds by the Kansas development finance authority in accordance with that statute for
any such capital improvement project.'';

Kansas or by this or other appropriation act of the 2000 regular session of the legislature,
as established by this or other appropriation act of the 2000 regular session of the legislature,
or as established by the state finance council on the number of full-time and regular part-
time positions equated to full-time for the fiscal year ending June 30, 2001, for the state
agencies for which such position limitations are established and for which positions are
abolished under subsection (a), are hereby decreased accordingly for each such agency by
the full-time equivalent number of such abolished positions.'';

the property is located, a public hearing on the proposed acquisition. At least 21 days before
the hearing, the department shall mail by first class mail to each owner of property adjoining
the property and shall publish in a newspaper of general circulation in the county a notice
of the time and place of the hearing. The notice shall contain a general description of the
property and shall state the proposed use of the property. At the hearing, all interested
parties shall be given reasonable opportunity to present their views regarding the acquisition
of the property and the proposed use of the property. Nothing in this subsection shall be
construed to prohibit expenditures, prior to the hearing required by this section, to secure
a contingency contract or to acquire an option to buy property, pending completion of the
hearing.''

before the first ``electric'' by inserting ``distribution electric cooperatives; one member rep-
resenting generation and transmission''; in line 25, before ``one'' by inserting ``one member
representing motor vehicle fuel dealers; one member representing motor vehicle fuel dis-
tributors;''; and the resolution be adopted as amended.

MESSAGE FROM THE SENATE
The Senate nonconcurs in House amendments to SB 481, requests a conference and has
appointed Senators Kerr, Hardenburger and Gooch as conferees on the part of the Senate.
