INTRODUCTION OF ORIGINAL MOTIONS AND SENATE RESOLUTIONS
 Senators Petty, Barone, Biggs, Downey, Feleciano, Gilstrap, Gooch, Goodwin, Jones, Lee,
Steineger and Stephens introduced the following Senate resolution, which was read:

      SENATE RESOLUTION No. 1846--

    A  RESOLUTION in memory of Marvin R. Webb.


      WHEREAS,  Marvin R. Webb, 80, of Topeka, died Tuesday, March 23, 1999, at a Topeka
hospital; and

      WHEREAS,  Mr. Webb was a chairman of the Kansas Democratic Veterans Club in
Topeka and the Farmers and Ranchers for the Michael Dukakis State Campaign, and he
was a delegate to the 1988 Democratic National Convention. He was ward captain and
precinct committee person for the Shawnee County Democratic Party. He was a member
of the Democratic Action Committee, Capitol Post No. 1 of the American Legion, Highland
Park Optimist Club, Lowman United Methodist Church, Highland Park United Methodist
Church and North Topeka Baptist Church. He was nominated to Who's Who in Mid-
America, and he was a member of the board of directors of St. John's Military School, Salina,
and the Topeka Home Builders Association; and

      WHEREAS,  Mr. Webb was the developer and managing partner of Southboro Estates
in Topeka, which opened in 1989. He had been the director of the Kansas Grain Inspection
Department, and he had worked for the United States Department of Energy at Camp Hill,
Pennsylvania, and in Kansas City, Missouri. He was an Army Air Corps veteran of World
War II. He also served as chairman of the Kansas Real Estate Commission; and

      WHEREAS,  He married Georgina Haydon Hensley on June 5, 1983, in Topeka. She
survives. Other survivors include a stepdaughter, Daryl Coleman, three stepsons, Randall
Hensley, Timothy Hensley, and Anthony Hensley, two grandchildren and four step
grandchildren. A son, W.L. Webb, preceded him in death: Now, therefore,

      Be it resolved by the Senate of the State of Kansas: That we extend our deepest sympathy
to the family of Marvin R. Webb; and

      Be it further resolved: That the Secretary of the Senate be directed to provide five
enrolled copies of this resolution to Mrs. Marvin R. Webb, 4240 SE Wisconsin Avenue,
Topeka, Kansas 66609.

   On emergency motion of Senator Petty SR 1846 was adopted unanimously.

   Senator Petty introduced as guests of the senate Georgina Webb, Mrs. Anthony Hensley
and daughter Katie, and Mr. and Mrs. Alan Coleman.

 In her remarks, Senator Petty described Mr. Webb as the consummate Democrat.

 Senator Hensley expressed appreciation and admiration for his stepfather.

 On behalf of the Senate, President Bond expressed condolences to the family.

REPORTS OF STANDING COMMITTEES
 Committee on Federal and State Affairs recommends SB 313 be not passed.

very troubling, we must do all we can to prevent a repeat of ``Gulf War illness'' in any future

coalitions with other states to call on Congress and the administration for action in
investigating and finding answers to Gulf War illness; and

KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
 (a) On the effective date of this act, the expenditure limitation established by section 5(d)
of chapter 202 of the 1998 Session Laws of Kansas on expenditures from the Kansas public
employees retirement fund for the technology project is hereby decreased from $2,400,000
to $2,325,000.

 (b) In addition to the other purposes for which expenditures may be made by the above
agency from the agency operations account of the Kansas public employees retirement fund
for the fiscal year ending June 30, 1999, as authorized by section 5(b) of chapter 202 or
section 99(b) of the 1998 Session Laws of Kansas, expenditures may be made by the above
agency for fiscal year 1999 for the purpose of paying bonus awards to unclassified employees
pursuant to procedures established by the board of trustees of the Kansas public employees
retirement system: Provided, That any expenditures for such purpose shall be in addition
to any expenditure on the agency operations account of such fund: Provided, however, That
the total amount of expenditures for such bonus awards to unclassified employees for fiscal
year 1999 shall not exceed $75,000.

 Sec. 44.

STATE TREASURER
 (a) On the effective date of this act, the expenditure limitation on the aggregate of all
expenditures for banking fees from the pooled money investment portfolio fee fund during
the fiscal year ending June 30, 1999, established by section 91(b) of chapter 203 of the 1998
Session Laws of Kansas is hereby increased from the limitation prescribed by that section
to No limit.

 Sec. 45.

KANSAS BOARD OF EXAMINERS IN FITTING AND DISPENSING
OF HEARING AIDS
 (a) On the effective date of this act, the expenditure limitation established for the fiscal
year ending June 30, 1999 by section 73(a) of chapter 203 of the 1998 Session Laws of
Kansas on the hearing aid board fee fund is hereby increased from $14,499 to $15,204.

 Sec. 46.

KANSAS STATE BOARD OF COSMETOLOGY
 (a) Notwithstanding the provisions of section 13(e) of chapter 202 of the 1998 Session
Laws of Kansas, expenditures may be made by the above agency from the cosmetology fee
fund for fiscal year 1999 for a new computer system, including computer software, to replace
the existing computer hardware and software.

 Sec. 47.

 DEPARTMENT OF COMMERCE AND HOUSING
 (a) On the effective date of this act, the expenditure limitation established by section
110(d) of chapter 203 of the 1998 Session Laws of Kansas on the state operations (including
official hospitality) subaccount of the Kansas economic development account of the state
economic development initiatives fund is hereby increased from $7,982,829 to $8,024,452.

 (b) On the effective date of this act, the expenditure limitation established by section
10(b) of chapter 202 of the 1998 Session Laws of Kansas on the Kansas economic
development endowment account of the state economic development initiatives fund is
hereby increased from $15,011,729 to $15,053,352.

 Sec. 48.

JUDICIAL COUNCIL
 (a) On the effective date of this act, of the $246,903 appropriated for the above agency
for the fiscal year ending June 30, 1999, by section 95(a) of chapter 203 of the 1998 Session
Laws of Kansas from the state general fund in the operating expenditures account, the sum
of $50,000 is hereby lapsed.

 Sec. 49.

STATE BOARD OF TAX APPEALS
 (a) There is appropriated for the above agency from the state general fund the following:

 Sec. 50.

DEPARTMENT OF HUMAN RESOURCES
 (a) On the effective date of this act, the expenditure limitation established by section
115(b) of chapter 203 of the 1998 Session Laws of Kansas on the occupational health and
safety--federal fund is hereby increased from $387,221 to $429,000.

 Sec. 51.

REAL ESTATE APPRAISAL BOARD
 (a) On the effective date of this act, the expenditure limitation established for the fiscal
year ending June 30, 1999, by section 78(a) of chapter 203 of the 1998 Session Laws of
Kansas on the appraiser fee fund is hereby increased from $174,693 to $184,197.'';

 By renumbering sections accordingly;

 In the title, in line 19, before ``department'' where it appears for the first time by inserting
``department on aging,''; in line 26, preceding ``Kansas'' where it appears for the last time
by inserting ``board of examiners in optometry,''; in line 28, by striking and and inserting a

moneys for fiscal year 2000 from appropriate accounts of the house system repairs,
equipment and improvement fund to renovate Ellsworth hall -- special revenue fund for
such capital improvement project.'';

that are inundated or saturated by surface or groundwater at a frequency and duration
sufficient to support, and under normal circumstances do support, a prevaleance of
hydrophytic vegetation typically adapted for life in saturated soil conditions.

 (p) During the fiscal year ending June 30, 2000, any expenditures by the department of
wildlife and parks from any moneys appropriated for fiscal year 2000, for land acquisition
related to the playa lakes project shall be for lands which are adjacent to playa lakes
properties that are already owned by the state: Provided, That no pumping of groundwater
may be done on any such newly acquired properties.'';

Provided, That the state board of regents is hereby authorized to transfer moneys from the
rehabilitation and repair projects, Americans with disabilities act compliance projects, state
fire marshal code compliance projects, and improvements to classroom projects for
institutions of higher education account to an account or accounts of the Kansas educational
building fund of any institution under the control and supervision of the state board of
regents to be expended by the institution for projects approved by the state board of regents:
Provided, however, That no expenditures shall be made from any such account until the
proposed projects have been reviewed by the joint committee on state building
construction.'';

 By renumbering sections accordingly;

 In the title, in line 23, by striking and ``and'' inserting a comma; also in line 23, after
``authority'' by inserting ``and state board of regents''; and the bill be passed as amended.

             The President withdrew HB 2228 from the Committee on Ways
            and Means, and rereferred the bill to the Committee on Elections
            and Local Government.

             The President withdrew HB 2197 from the Committee on Ways
            and Means, and returned the bill to the calendar under the heading
            of General Orders.

             The President withdrew HB 2075, 2082, 2224 from the
            Committee on Ways and Means, and rereferred the bills to the
            Committee on Judiciary.
