      Heavenly Father,

      On this first day of the session, before things get too hectic; before the woods get

INTRODUCTIONS

President Bond introduced Dr. John Ryan, President of the Kansas Academy of Family
Physicians. Dr. Ryan is in private practice in Marysville, Kansas. The Academy sponsors the
doctor of the day program and provides daily assistance for health concerns in the Capitol
during the session.

Introduced as the new reader was David Lawler, Topeka, a third-year law student at
Washburn University. David received his bachelor's of arts degree from Friends University
in Wichita, Kansas.

Also recognized were the new Assistant Sergeant-at-Arms, Ken Bauman; doorman, Jody
Kirkwood; and from the Highway Patrol, Trooper Brian Smith and Sgt. Don Cackler serving
the Senate.

SENATE CONCURRENT RESOLUTION No. 1615--

By Special Committee on Education



A PROPOSITION to amend section 2 of article 6 of the constitution of the state of Kansas,
      relating to the state board of education.

      Be it resolved by the Legislature of the State of Kansas, two-thirds of the members elected
      (or appointed) and qualified to the Senate and two-thirds of the members elected (or
      appointed) and qualified to the House of Representatives concurring therein:

          Section 1. The following proposition to amend the constitution of the state of Kansas
shall be submitted to the qualified electors of the state for their approval or rejection: Section
2 of article 6 of the constitution of the state of Kansas is hereby amended to read as follows:
      ``§2. State board of education and state board of regents. (a) The legislature
      shall provide for a state board of education which shall have and for its general
      supervision of public schools, educational institutions and all the educational interests
      of the state, except educational functions delegated by law to the state board of
      regents. The state board of education shall perform such other duties as may be
      ;'ovided prescribed by law.

      (b) The legislature shall provide for a state board of regents and for its control
      and supervision of public institutions of higher education. Public institutions of
      higher education shall include universities and colleges granting baccalaureate or
      postbaccalaureate degrees and such other institutions and educational interests as
      may be provided by law. The state board of regents shall perform such other duties
      as may be prescribed by law.

      (c) Any municipal university shall be operated, supervised and controlled as pro-
      vided by law.

``Sec. 2. The following statement shall be printed on the ballot with the amendment as
a whole:

      ``Explanatory statement. This amendment would eliminate the constitutional
      power of the state board of education to generally supervise the public schools with-
      out being subject to statutory guidelines prescribed by the legislature.

      ``A vote for this proposition would give greater accountability of the state board
      of education to the people through their representation by the legislative branch of
      government. The state board of education would be responsible for implementation
      of public school policy under statutory directives adopted by the legislature.

      ``A vote against this proposition would continue in effect the authority of the state
      board of education to exercise legislative power in establishing policy regarding the
      public schools independent of direct input by the legislature.''

    Sec. 3. This resolution, if approved by two-thirds of the members elected (or appointed)
and qualified to the Senate and two-thirds of the members elected (or appointed) and
qualified to the House of Representatives, shall be entered on the journals, together with
the yeas and nays. The secretary of state shall cause this resolution to be published as
provided by law and shall cause the proposed amendment to be submitted to the electors
of the state at the general election to be held in the year 1998 unless a special election is
called at a sooner date by concurrent resolution of the legislature, in which case it shall be
submitted to the electors of the state at the special election.

In fulfillment of requirements of 1996, HB 2600, the Task Force on Retail Wheeling,
submitted its Final Report to the 1998 Kansas Legislature.

Robin Kempf, Research Analyst and Bill Wolff, Associate Director, submitted the final
report of the Task Force on the Kansas Insurance Industry pursuant to the provisions of
S.C.R. 1601, which require the Task Force to present its conclusions and recommendations
by January 12, 1998.

The President announced the above reports are on file in the office of the Secretary of the
Senate and available for review at any time.

Announcing adoption of HCR 5031, a concurrent resolution relating to a committee to
wait upon the governor and advise him the 1998 session of the legislature is organized and
ready to receive communications, and the appointment of Representatives Shore, Jeff Pe-
terson and Gilbert as members of the committee to wait upon the governor.

Also, announcing the adoption of HCR 5032, a concurrent resolution providing for a
joint session of the Senate and House of Representatives for the purpose of hearing a
message from the governor, and the appointment of Representatives Cook, Wilson and
Wempe to wait upon the governor.

Also, Representatives Glasscock, O'Neal and McKechnie to wait upon the Lieutenant
Governor.

Also, Representatives Palmer, Powell and Minor to escort the Senate.

INTRODUCTION OF HOUSE BILLS AND CONCURRENT RESOLUTIONS

HCR 5031, A concurrent resolution relating to a committee to inform the Governor the
two houses of the legislature are duly organized and ready to receive communications, was
introduced and read by title.

On motion of Senator Emert, an emergency was declared, the rules suspended and HCR
5031, was adopted by voice vote.

In compliance with HCR 5031, President Bond appointed Senators Vidricksen and Biggs
to notify the Governor.

HCR 5032, A concurrent resolution for a joint session of the Senate and House for the
purpose of hearing a message from the Governor, was introduced and read by title.

On motion of Senator Emert, an emergency was declared, the rules suspended and HCR
5032, was adopted by voice vote.

In compliance with HCR 5032, President Bond appointed Senators Ranson and Fele-
ciano to escort the Governor, and Senators Jordan and Downey to escort the Lt. Governor.
