While I support the original proposal, this bill now provides a $22 million tax cut for big out-of-state insurance companies, while Kansas insurance companies will see only a $2 million tax cut. Under this bill there is no incentive for insurance companies to provide jobs in Kansas, the only thing it provides is welfare for out-of-state insurance companies. This is $22 million of tax relief that won't be going to Kansas families. This is true trickle down tax policy. This is bad tax policy for Kansans. I vote NO.--Tom Burroughs, Annie Kuether, Nancy Kirk, Tom Sawyer, Ruby Gilbert, Marti Crow, Douglas E. Johnston, L. Candy Ruff, Dixie Toelkes, Bill Reardon, George Dean Mr. Speaker: I vote yes on HB 2082. It corrects constitutional problems due to Metropolitan Life v. Ward, estimated exposure of $500,000,000. The bill simplifies insurance laws by eliminating the existing dual tax rate structure. The expected growth of insurance tax revenues in future years together with the 10 year phase-in period should ensure that out-of-state companies will pay the same amount or more of taxes at the end of the phase-in period. The bill does not increase taxers on in-state companies. The state's largest domestic insurance company officially supports the bill. Kansas companies will pay less retaliatory taxes, promoting economic growth.--Tom Bradley, Becky Hutchins, Joann Flower, Billie Vining, Donald L. Dahl, Deena Horst, Kenny A. (4) Except as provided by subsection (7) (8), a prosecution for rape, as defined in K.S.A. 21-3502 and amendments thereto, or aggravated criminal sodomy, as defined in K.S.A. 213506 and amendments thereto, must be commenced within five years after its commission. (5) Except as provided in subsection (7) (8), a prosecution for any crime found in the Kansas medicaid fraud control act must be commenced within five years after its commission. (6) Except as provided by subsection (8), a prosecution for the crime of arson, as defined in K.S.A. 21-3718 and amendments thereto, or aggravated arson, as defined in K.S.A. 213719, and amendments thereto, must be commenced within five years after its commission. (7) Except as provided by subsection (7) (8), a prosecution for any crime not governed by subsections (1), (2), (3), (4) and, (5) and (6) must be commenced within two years after it is committed. (7) (8) The period within which a prosecution must be commenced shall not include any period in which: (a) The accused is absent from the state; (b) the accused is concealed within the state so that process cannot be served upon the accused; (c) the fact of the crime is concealed; February 27, 1997 335 (d) a prosecution is pending against the defendant for the same conduct, even if the indictment or information which commences the prosecution is quashed or the proceedings thereon are set aside, or are reversed on appeal; (e) an administrative agency is restrained by court order from investigating or otherwise proceeding on a matter before it as to any criminal conduct defined as a violation of any of the provisions of article 41 of chapter 25 and article 2 of chapter 46 of the Kansas Statutes Annotated which may be discovered as a result thereof regardless of who obtains the order of restraint; or (f) whether or not the fact of the crime is concealed by the active act or conduct of the accused, there is substantially competent evidence to believe two or more of the following factors are present: (i) The victim was a child under 15 years of age at the time of the crime; (ii) the victim was of such age or intelligence that the victim was unable to determine that the acts constituted a crime; (iii) the victim was prevented by a parent or other legal authority from making known to law enforcement authorities the fact of the crime whether or not the parent or other legal authority is the accused; and (iv) there is substantially competent expert testimony indicating the victim psychologically repressed such witness' memory of the fact of the crime, and in the expert's professional opinion the recall of such memory is accurate and free of undue manipulation, and substantial corroborating evidence can be produced in support of the allegations contained in the complaint or information but in no event may a prosecution be commenced as provided in this section later than the date the victim turns 28 years of age. Corroborating evidence may include, but is not limited to, evidence the defendant committed similar acts against other persons or evidence of contemporaneous physical manifestations of the crime. ``Parent or other legal authority'' shall include but not be limited to natural and stepparents, grandparents, aunts, uncles or siblings. (8) (9) An offense is committed either when every element occurs, or, if a legislative purpose to prohibit a continuing offense plainly appears, at the time when the course of conduct or the defendant's complicity therein is terminated. Time starts to run on the day after the offense is committed. (9) (10) A prosecution is commenced when a complaint or information is filed, or an indictment returned, and a warrant thereon is delivered to the sheriff or other officer for execution. (a) Whenever the governing body of any city finds and determines by resolution that it is necessary to acquire a site or sites for the disposal of refuse or solid waste as defined by K.S.A. 65-3402(a) and amendments thereto within or without the city, it the city may acquire such site or sites by gift, purchase or condemnation and may construct necessary facilities thereon and purchase necessary equipment for the disposal of such refuse or solid waste. In the event the governing body of such city finds that it is necessary to acquire such site or sites by condemnation, the governing body of the city shall proceed under the provisions of K.S.A. 26-501 to 26-516 inclusive, and amendments thereto. Whenever any such city shall so condemn such a site or sites, said city shall acquire a fee simple title thereto. In order to pay for such site or sites and the construction of all such necessary facilities and equipment to be used in the disposal of refuse or solid waste, the governing body of such city is authorized to issue general bonds of the city in the manner provided by law for the issuance of general improvements bonds of the city. (b) Any site or sites acquired pursuant to this section, and any facilities or equipment thereon, shall be subject to all permit and other requirements of the solid waste management laws of this state. Sec. 3. K.S.A. 19-2658 is hereby amended to read as follows: 19-2658. (a) The board of county commissioners of any county is hereby authorized to acquire by lease, condemnation or purchase, lands to be used as a site for the disposal of refuse. ``Refuse'' for the purposes of this act shall include garbage, trash and solid waste. Upon the acquisition of any such site, the board may build or construct any necessary buildings, incinerators or other structures or improvements thereon and may acquire or make use of any equipment presently owned by the county necessary for the proper, effective and sanitary disposal of refuse. If the board of county commissioners shall deem it to be in the best interests of the county, such board may in lieu of acquiring a site as hereinbefore authorized, contract with any city or cities located within such county and having a refuse disposal site, for the use of such disposal site upon such terms and conditions as may be agreed upon by the board of county commissioners and the governing body of the city and may acquire equipment or make use of any equipment presently owned by the county pursuant thereto.
