11             AN  ACT concerning state agencies; acquisition of office space in non-
12             state-owned buildings and facilities; prescribing powers, duties and
13             functions for the department of administration.
14      
15       Be it enacted by the Legislature of the State of Kansas:
16             Section  1. (a) On and after the effective date of this act, all leases for
17       office space in nonstate-owned buildings and facilities for state officers
18       and employees shall be negotiated and entered into by the secretary of
19       administration, or the secretary's designee, in accordance with this section
20       and the policies and procedures adopted thereunder. The secretary of
21       administration shall plan and coordinate the leasing of office space in
22       nonstate-owned buildings and facilities for state officers and employees
23       of all state agencies. The head of each state agency shall provide infor-
24       mation to and cooperate with the secretary of administration for the pur-
25       poses of implementing and administering this section and the policies and
26       procedures prescribed by the secretary of administration.
27             (b) The secretary of administration shall develop and adopt policies
28       and procedures for centralizing the function of leasing of office space in
29       nonstate-owned buildings and facilities for state officers and employees
30       of all state agencies. After June 30, 2000, each existing lease of office
31       space for state officers and employees in nonstate-owned buildings and
32       facilities may be renewed or extended only upon approval by the secretary
33       of administration and in accordance with policies and procedures pre-
34       scribed by the secretary.
35             (c) The secretary of administration may delegate authority to any
36       state agency to negotiate and enter into leases for office space in nonstate-
37       owned buildings and facilities for state officers and employees of the state
38       agency, including renewals or extensions of existing leases, under condi-
39       tions and procedures prescribed by the secretary in accordance with this
40       section.
41             (d) No lease of office space for state officers and employees in non-
42       state-owned buildings or facilities, which is for the lease of more than
43       10,000 net assignable square feet or for a term longer than 60 24 months,

  1       shall be entered into or approved by the secretary of administration unless
  2       the secretary of administration has first advised and consulted with the
  3       joint committee on state building construction.
  4        (e) The secretary of administration is hereby authorized to fix,
  5       charge and collect a lease negotiation service fee to recover the costs
  6       incurred by the department in providing lease negotiation services
  7       under this section. Such fee shall be paid in annual installments
  8       over the term of such lease. Such fees shall be deposited in the state
  9       treasury and credited to the state buildings operating fund.
10             (f) Nothing in this section shall be construed as requiring the
11       renegotiation of the terms of any lease in existence on July 1, 2000.
12       At the request of an agency, the secretary may renegotiate a lease
13       in existence on July 1, 2000.
14        Sec.  2. This act shall take effect and be in force from and after its
15       publication in the statute book.
