10             AN  ACT concerning sun screening devices on motor vehicles; relating
11             to law enforcement officers and private detectives; amending K.S.A.
12             8-1749a and repealing the existing section.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 8-1749a is hereby amended to read as follows: 8-
16       1749a. (a) No motor vehicle required to be registered in this state and
17       which is operated on the highways of this state shall be equipped with
18       one-way glass or any sun screen device, as defined in K.S.A. 8-1749b, and
19       amendments thereto, and used in conjunction with safety glazing materials
20       that do not meet the following requirements:
21             (1) A sun screening device when used in conjunction with the wind-
22       shield shall be nonreflective and shall not be red, yellow or amber in
23       color. A sun screening device shall be used only along the top of the
24       windshield and shall not extend downward beyond the AS1 line which is
25       clearly defined and marked;
26             (2) a sun screening device when used in conjunction with the safety
27       glazing materials of the side wings or side windows located at the im-
28       mediate right and left of the driver, the side windows behind the driver
29       and the rear most window shall be nonreflective; and
30             (3) the total light transmission shall not be less than 35% when a sun
31       screening device is used in conjunction with safety glazing materials or
32       other existing sun screening devices, except that the provision of this
33       subsection (a)(3) shall not apply to motor vehicles owned and operated
34       by law enforcement officers and private detectives licensed pursuant to
35       the provisions of K.S.A. 75-7b01 et seq., and amendments thereto and
36       motor vehicles owned and operated by any law enforcement agency or
37       private detective agency licensed pursuant to the provisions of K.S.A. 75-
38       7b01 et seq., and amendments thereto.
39             (b) The superintendent of the highway patrol may adopt such rules
40       and regulations necessary to carry out the provisions of subsection (a).
41             (c) This section shall not prohibit labels, stickers or other informa-
42       tional signs that are required or permitted by state law.
43             (d) No motor vehicle required to be registered in this state which is

  1       operated on the highways of this state shall be equipped with head lamps
  2       which are covered with any sun screen device, adhesive film or other
  3       glaze or application which, when such lamps are not in operation, is highly
  4       reflective or otherwise nontransparent.
  5             (e)  (1) From and after July 1, 1987, and prior to January 1, 1988, a law
  6       enforcement officer shall issue a warning citation to any person violating
  7       the provisions of this section.
  8             (2) From and after January 1, 1988, any person convicted of violating
  9       the provisions of this section shall be guilty of a misdemeanor.
10             (f) Any motor vehicle exempted under the provisions of subsection
11       (a)(3), shall be required to comply with the provisions of this section if:
12             (1) Such motor vehicle is sold or otherwise disposed of; or
13             (2) if the owner of such motor vehicle is no longer licensed as a private
14       detective or as a private detective agency. 
15       Sec.  2. K.S.A. 8-1749a is hereby repealed.
16        Sec.  3. This act shall take effect and be in force from and after its
17       publication in the statute book.
