  9             AN  ACT concerning professions regulated by the behavioral sciences
10             regulatory board; relating to disclosure; amending section 4 of chapter
11             117 of the 1999 Session Laws of Kansas, section 17 of chapter 117 of
12             the 1999 Session Laws of Kansas, section 26 of chapter 117 of the 1999
13             Session Laws of Kansas and section 31 of chapter 117 of the 1999
14             Session Laws of Kansas and repealing the existing sections.

16       Be it enacted by the Legislature of the State of Kansas:
17             Section  1. Section 4 of chapter 117 of the 1999 Session Laws of Kan-
18       sas is hereby amended to read as follows: A licensee under the profes-
19       sional counselors licensure act, at the beginning of a client-therapist re-
20       lationship, shall inform the client of the level of such licensee's training
21       and the title or titles and license or licenses of such licensee. As a part of
22       such obligation, such licensee shall disclose whether such licensee has a
23       master's degree or a doctoral degree. If such licensee has a doctoral de-
24       gree, such licensee shall disclose whether or not such doctoral degree is
25       a doctor of medicine degree or some other doctoral degree. If such li-
26       censee does not have a medical doctor's degree, such licensee shall dis-
27       close that the licensee is not authorized to practice medicine and surgery
28       and is not authorized to prescribe drugs. As a part of such disclosure,
29       such licensee shall advise the client that certain mental disorders can have
30       medical or biological origins, and that the client should consult with a
31       physician. Documentation of such disclosures to a client shall be made in
32       the client's record.
33             Sec.  2. Section 17 of chapter 117 of the 1999 Session Laws of Kansas
34       is hereby amended to read as follows: A licensee, under the provisions of
35       article 63 of chapter 65 of the Kansas Statutes Annotated, at the beginning
36       of a client-therapist relationship, shall inform the client of the level of
37       such licensee's training and the title or titles and license or licenses of
38       such licensee. As a part of such obligation, such licensee shall disclose
39       whether such licensee has a master's degree or a doctoral degree. If such
40       licensee has a doctoral degree, such licensee shall disclose whether or not
41       such doctoral degree is a doctor of medicine degree or some other doc-
42       toral degree. If such licensee does not have a medical doctor's degree,

  1       such licensee shall disclose that the licensee is not authorized to practice
  2       medicine and surgery and is not authorized to prescribe drugs. As a part
  3       of such disclosure, such licensee shall advise the client that certain mental
  4       disorders can have medical or biological origins, and that the client should
  5       consult with a physician. Documentation of such disclosures to a client
  6       shall be made in the client's record.
  7             Sec.  3. Section 26 of chapter 117 of the 1999 Session Laws of Kansas
  8       is hereby amended to read as follows: A licensee under the licensure of
  9       psychologists act of the state of Kansas, at the beginning of a client-ther-
10       apist relationship, shall inform the client of the level of such licensee's
11       training and the title or titles and license or licenses of such licensee. As
12       a part of such obligation, such licensee shall disclose whether such li-
13       censee has a master's degree or a doctoral degree. If such licensee has a
14       doctoral degree, such licensee shall disclose whether or not such doctoral
15       degree is a doctor of medicine degree or some other doctoral degree. If
16       such licensee does not have a medical doctor's degree, such licensee shall
17       disclose that the licensee is not authorized to practice medicine and sur-
18       gery and is not authorized to prescribe drugs. As a part of such disclosure,
19       such licensee shall advise the client that certain mental disorders can have

24       are hereby amended to read as follows: A licensee under K.S.A. 74-5361
25       et seq. and amendments thereto, at the beginning of a client-therapist
26       relationship, shall inform the client of the level of such licensee's training
27       and the title or titles and license or licenses of such licensee. As a part of
28       such obligation, such licensee shall disclose whether such licensee has a
29       masters degree or a doctoral degree. If such licensee has a doctoral de-
30       gree, such licensee shall disclose whether or not such doctoral degree is
31       a doctor of medicine degree or some other doctoral degree. If such li-
32       censee does not have a medical doctor's degree, such licensee shall dis-
33       close that the licensee is not authorized to practice medicine and surgery
34       and is not authorized to prescribe drugs. As a part of such disclosure,
35       such licensee shall advise the client that certain mental disorders can have
36       medical or biological origins, and that the client should consult with a

39       Sec.  5. Section 4 of chapter 117 of the 1999 Session Laws of Kansas,
40       section 17 of chapter 117 of the 1999 Session Laws of Kansas, section 26
41       of chapter 117 of the 1999 Session Laws of Kansas, and chapter 31 of
42       chapter 117 of the 1999 Session Laws of Kansas hereby repealed.

  1        Sec.  6. This act shall take effect and be in force from and after its
  2       publication in the statute book.
