10             AN  ACT concerning health insurance; providing coverage for osteopo-
11             rosis; amending K.S.A. 1999 Supp. 40-2,103 and 40-19c09 and re-
12             pealing the existing sections.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             New Section  1. This act shall be known as the ``bone mass measure-
16       ment coverage act.''
17             New Sec.  2. The purpose of this act is to provide insurance coverage
18       to individuals with a condition or medical history for which bone mass
19       measurement (bone density testing) is determined to be medically nec-
20       essary for the individual's diagnosis and treatment of osteoporosis.
21             New Sec.  3. (a) Any individual or group health insurance policy,
22       medical service plan, contract, hospital service corporation contract, hos-
23       pital and medical service corporation contract, fraternal benefit society
24       or health maintenance organization which provides coverage for accident
25       and health services and which is delivered, issued for delivery, amended
26       or renewed on or after July 1, 2000, shall provide coverage for any qual-
27       ified individuals for the diagnosis and treatment of osteoporosis.
28             (b) For the purposes of this section:
29             (1) ``Bone mass measurement'' means a radiologic or radioisotopic
30       procedure or other scientifically proven technologies performed on an
31       individual for the purpose of identifying bone mass or detecting bone
32       loss.
33             (2) ``Qualified individual'' means a person with a condition for which
34       bone mass measurement is determined to be medically necessary by the
35       person's attending physician or primary care physician.
36             (c) The provisions of this section shall not apply to any policy or cer-
37       tificate which provides coverage for any specified disease, specified ac-
38       cident or accident only coverage, credit, dental, disability income, hospital
39       indemnity, long-term care insurance as defined by K.S.A. 40-2227 and
40       amendments thereto, vision care or any other limited supplemental ben-
41       efit nor to any medicare supplement policy of insurance as defined by
42       the commissioner of insurance by rule and regulation, any coverage issued
43       as a supplement to liability insurance, workers compensation or similar

  1       insurance, automobile medical-payment insurance or any insurance un-
  2       der which benefits are payable with or without regard to fault, whether
  3       written on a group, blanket or individual basis.
  4             Sec.  4. K.S.A. 1999 Supp. 40-2,103 is hereby amended to read as
  5       follows: 40-2,103. The requirements of K.S.A. 40-2,100, 40-2,101, 40-
  6       2,102, 40-2,104, 40-2,105, 40-2,114 and 40-2250, and amendments
  7       thereto and K.S.A. 1999 Supp. 40-2,160 and, 40-2,165 through 40-2,170,
  8       and section 3, and amendments thereto, shall apply to all insurance pol-
  9       icies, subscriber contracts or certificates of insurance delivered, renewed
10       or issued for delivery within or outside of this state or used within this
11       state by or for an individual who resides or is employed in this state.
12             Sec.  5. K.S.A. 1999 Supp. 40-19c09 is hereby amended to read as
13       follows: 40-19c09. (a) Corporations organized under the nonprofit med-
14       ical and hospital service corporation act shall be subject to the provisions
15       of the Kansas general corporation code, articles 60 to 74, inclusive, of
16       chapter 17 of the Kansas Statutes Annotated, applicable to nonprofit cor-
17       porations, to the provisions of K.S.A. 40-214, 40-215, 40-216, 40-218, 40-
18       219, 40-222, 40-223, 40-224, 40-225, 40-226, 40-229, 40-230, 40-231, 40-
19       235, 40-236, 40-237, 40-247, 40-248, 40-249, 40-250, 40-251, 40-252,
20       40-254, 40-2,100, 40-2,101, 40-2,102, 40-2,103, 40-2,104, 40-2,105, 40-
21       2,116, 40-2,117, 40-2a01 et seq., 40-2111 to 40-2116, inclusive, 40-2215
22       to 40-2220, inclusive, 40-2221a, 40-2221b, 40-2229, 40-2230, 40-2250,
23       40-2251, 40-2253, 40-2254, 40-2401 to 40-2421, inclusive, and 40-3301
24       to 40-3313, inclusive, K.S.A. 1999 Supp. 40-2,153, 40-2,154, 40-2,160,
25       40-2,161, 40-2,163, 40-2,164 and, 40-2,165 through 40-2,170, and section
26       3, and amendments thereto, except as the context otherwise requires, and
27       shall not be subject to any other provisions of the insurance code except
28       as expressly provided in this act.
29             (b) No policy, agreement, contract or certificate issued by a corpo-
30       ration to which this section applies shall contain a provision which ex-
31       cludes, limits or otherwise restricts coverage because medicaid benefits
32       as permitted by title XIX of the social security act of 1965 are or may be
33       available for the same accident or illness.
34             (c) Violation of subsection (b) shall be subject to the penalties pre-
35       scribed by K.S.A. 40-2407 and 40-2411, and amendments thereto. 
36       Sec.  6. K.S.A. 1999 Supp. 40-2,103 and 40-19c09 are hereby
37       repealed.
38        Sec.  7. This act shall take effect and be in force from and after its
39       publication in the statute book.
