  9             AN  ACT establishing the Kansas board of regents legacy scholarship pro-
10             gram; relating to administration of awards made under such program.
11      
12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. As used in this act:
14             (a) ``Kansas board of regents legacy scholarship program'' means a
15       program under which grants of financial assistance in the form of schol-
16       arships are awarded by this state to Kansas legacy scholars.
17             (b) ``State educational institution'' has the meaning ascribed thereto
18       in K.S.A. 76-711, and amendments thereto.
19             (c) ``Kansas legacy scholar'' means a person who: (1) Is a nonresident
20       of this state and is initially acceptable for entering a state educational
21       institution for the fall 2000 semester, and thereafter a student who has
22       so entered and is in good standing; (2) has at least one biological or adop-
23       tive parent or grandparent who has received an undergraduate or higher
24       degree from the state educational institution the person applying for the
25       Kansas legacy scholarship is entering or has so entered; and (3) maintains
26       a 3.25 grade point average on a 4.0 scale while enrolled for at least 12
27       hours each semester in a specified degree program at a state educational
28       institution, except that no Kansas legacy scholar who has completed eight
29       semesters, graduated from a state educational institution or has received
30       a waiver of nonresident fees from any other source or scholarship shall
31       be eligible to receive a Kansas legacy scholarship.
32             (d) ``Board of regents'' means the state board of regents provided for
33       in the constitution of this state and described in article 32 of chapter 74
34       of Kansas Statutes Annotated.
35             (e) ``Semester'' means one of two principal terms, when there are
36       only two principal terms in the academic year, whether or not there are
37       other shorter terms during the same academic year.
38             Sec.  2. A Kansas legacy scholarship shall be awarded to any Kansas
39       legacy scholar qualified pursuant to subsection (c) of section 1, and
40       amendments thereto. The amount of a Kansas legacy scholarship shall be
41       equal to the amount necessary to make such scholar's tuition and fees the
42       average of resident and nonresident tuition and fees charged by the state
43       educational institution for the hours enrolled in for the semester such

  1       scholarship is awarded as determined by the board of regents.
  2             Sec.  3. (a) Kansas legacy scholarships shall be paid upon certification
  3       by the state educational institution that the Kansas legacy scholar is eli-
  4       gible, enrolled and qualified. Payments of Kansas legacy scholarships shall
  5       be made upon vouchers approved by the administrative officer of the
  6       board of regents designated by the board of regents upon warrants of the
  7       director of accounts and reports. Payments of Kansas legacy scholarships
  8       may be made by the issuance of a single warrant to each state educational
  9       institution at which a Kansas legacy scholar is enrolled for the total
10       amount of Kansas legacy scholarships for all Kansas legacy scholars en-
11       rolled at that institution. The director of accounts and reports shall cause
12       such warrant to be delivered to the state educational institution at which
13       such scholar or scholars are enrolled. Upon receipt of such warrant, the
14       amount thereof shall be credited to the Kansas legacy scholarship fund
15       of the the state educational institution and allocated within the fund to
16       the account of each Kansas legacy scholar enrolled at that institution. The
17       amount to be credited to the account of each such scholar shall be spec-
18       ified by the board of regents.
19             (b) If a Kansas legacy scholar discontinues attendance before the end
20       of any semester, after the state educational institution has received pay-
21       ment under this section, the state educational institution shall debit the
22       account of the scholar by an amount equal to the entire amount which
23       such scholar would otherwise qualify to have refunded, not to exceed the
24       amount credited to the account of the scholar under a Kansas legacy
25       scholarship for the semester and, if a Kansas legacy scholar has received
26       payments under any federal program of student assistance in the semes-
27       ter, less an amount equal to the pro rata share of such entire amount
28       which is attributable to the assistance received by the scholar under such
29       federal program or programs.
30             (c) All amounts debited by a state educational institution under sub-
31       section (b) shall be reallocated within the Kansas legacy scholarship fund
32       of the state educational institution to the account of other Kansas legacy
33       scholars as specified by the board of regents.
34             Sec.  4. The board of regents shall administer the Kansas board of
35       regents legacy scholarship program and shall:
36             (a) Publicize Kansas legacy scholarships and provide information re-
37       garding application procedures;
38             (b) designate and notify each Kansas legacy scholar;
39             (c) approve and award Kansas legacy scholarships;
40             (d) evaluate the Kansas board of regents legacy scholarship program
41       annually, and make a report thereon to the governor and the legislature;
42       and
43             (e) require any state educational institution to promptly furnish any

  1       information which the board of regents requests relating to administration
  2       or effect of this program.
  3             Sec.  5. Each applicant for a Kansas legacy scholarship, in accordance
  4       with rules and regulations of the board of regents, shall:
  5             (a) Be responsible for submission to the board of regents of evidence
  6       of information, as specified by the board of regents, to satisfy the require-
  7       ments of paragraph (2) of subsection (c) of section 1, and amendments
  8       thereto;
  9             (b) complete and file an application for a Kansas legacy scholarship;
10       and
11             (c) report promptly to the board of regents any information requested
12       relating to administration of this program.
13        Sec.  6. This act shall take effect and be in force from and after its
14       publication in the statute book.
