10             AN  ACT concerning the electronic pharmacy claims management sys-
11             tem; amending K.S.A. 1999 Supp. 39-7,121 and repealing the existing
12             section.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 1999 Supp. 39-7,121 is hereby amended to read as
16       follows: 39-7,121. (a) On or before July 1, 1996, the department of social
17       and rehabilitation services shall establish and implement an electronic
18       pharmacy claims management system in order to provide for the on-line
19       adjudication of claims and for electronic prospective drug utilization
20       review.
21             (b) The system shall provide for electronic point-of-sale review of
22       drug therapy using predetermined standards to screen for potential drug
23       therapy problems including incorrect drug dosage, adverse drug-drug in-
24       teractions, drug-disease contraindications, therapeutic duplication, incor-
25       rect duration of drug treatment, drug-allergy interactions and clinical
26       abuse or misuse.
27             (c) The department shall not utilize this system, or any other system
28       or program to require that a recipient has utilized or failed with a drug
29       usage or drug therapy prior to allowing the recipient to receive the prod-
30       uct or therapy recommended by the recipient's physician. 
31       Sec.  2. K.S.A. 1999 Supp. 39-7,121 is hereby repealed.
32        Sec.  3. This act shall take effect and be in force from and after its
33       publication in the statute book.
