10             AN  ACT creating the wildlife and parks nonrestricted fund.

12       Be it enacted by the Legislature of the State of Kansas:
13             Sec  1. (a) All moneys received by the department of wildlife and
14       parks from sources other than those identified and restricted in K.S.A.
15       32-990, 32-991, 32-992, 32-993, 32-994 and 32-1173, and amendments
16       thereto, or identified and allocated to a restricted fund by any appropri-
17       ation act, shall be remitted to the state treasurer in accordance with the
18       provisions of K.S.A. 75-4215 and amendments thereto. The state trea-
19       surer shall deposit the entire amount of the remittance in the state treas-
20       ury and credit it to the wildlife and parks nonrestricted fund, which is
21       hereby created.
22             (b) All expenditures from the wildlife and parks nonrestricted fund
23       may be for federal aid eligible expenditures at the discretion of the
24       secretary.
25             (c) On or before the 10th day of each month, the director of accounts
26       and reports shall transfer from the state general fund to the wildlife and
27       parks nonrestricted fund interest earnings based on:
28             (1) The average daily balance of moneys in the wildlife and parks
29       nonrestricted fund for the preceding month; and
30             (2) the net earnings rate of the pooled money investment portfolio
31       for the preceding month.
32             (d) All expenditures from the wildlife and parks nonrestricted fund
33       shall be made in accordance with appropriation acts upon warrants of the
34       director of accounts and reports issued pursuant to vouchers approved
35       by the secretary.
36             Sec  2. This act shall take effect and be in force from and after its
37       publication in the statute book.
