  9             AN  ACT relating to wage payment; concerning the electronic deposit
10             thereof; amending K.S.A. 1999 Supp. 44-314 and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 1999 Supp. 44-314 is hereby amended to read as
15       follows: 44-314. (a) Every employer shall pay all wages due to the em-
16       ployees of the employer at least once during each calendar month, on
17       regular paydays designated in advance by the employer, in lawful money
18       of the United States or with checks or drafts which are negotiable in the
19       community wherein the place of employment is located or, with the writ-
20       ten consent of the employee, by electronic deposit to an employee's ac-
21       count at a financial institution if the electronic deposit is made at no cost
22       or expense to the employee.
23             (b) The end of the pay period for which payment is made on a regular
24       payday shall be not more than 15 days before such regular payday unless
25       a variance in such requirement is authorized by state or federal law. 
26       Sec.  2. K.S.A. 1999 Supp. 44-314 is hereby repealed.
27        Sec.  3. This act shall take effect and be in force from and after its
28       publication in the statute book.
