10             AN  ACT repealing K.S.A. 1999 Supp. 58-2005; relating to plats. [AN
11             ACT concerning plats; amending K.S.A. 1999 Supp. 58-2005 and
12             repealing the existing section.]

14       Be it enacted by the Legislature of the State of Kansas:
15             [Section  1. K.S.A. 1999 Supp. 58-2005 is hereby amended to
16       read as follows: 58-2005. Before a subdivision plat or plat of survey
17       may be recorded, it shall be reviewed by the county surveyor. In
18       the absence of the county surveyor, the county engineer may contract
19       with a land surveyor who shall review such subdivision plat or plat of
20       survey and certify the same if in compliance with the requirements of this
21       act In the event the county does not have a designated county surveyor,
22       then the county engineer shall review the plat providing the county en-
23       gineer is also a registered land surveyor. In the absence of both a county
24       surveyor and a county engineer the plat shall be reviewed by a registered
25       land surveyor designated by the county. All cost for plat review and ap-
26       proval shall be charged back to the applicant for plat approval. The county
27       shall be responsible for the enforcement of this act; the county surveyor
28       or county engineer shall certify that such plat meets all the requirements
29       of this act. In the event that any such plat is required to be submitted to
30       any planning commission for review and approval or disapproval, such
31       review and approval duly certified upon the face of such plat shall not
32       constitute full compliance with the review required in this section unless
33       reviewed by the county surveyor or county engineer.]
34             Section  1. 2. K.S.A. 1999 Supp. 58-2005 is hereby repealed.
35        Sec.  2. 3. This act shall take effect and be in force from and after its
36       publication in the statute book.
