12             AN  ACT relating to [transfers of specified funds; concerning fund-
13             ing for] the Kansas sports hall of fame; providing for the transfer of
14             specified funds for the support thereof [relating to special educa-
15             tion funding].

17       Be it enacted by the Legislature of the State of Kansas:
18             Section  1. (a) On and after July 1, 2000, on each January 1, April 1,
19       July 1 and October 1, the secretary of revenue shall certify to July 1,
20       2000, and on each July 1 thereafter, the director of accounts and
21       reports the amount equal to the total revenues received by the secretary
22       shall transfer $80,000 from the state general fund to the Kansas
23       sports hall of fame fund. The amount so transferred is hereby de-
24       termined to be substantially equivalent to the revenues received
25       by the state from the taxes imposed under the Kansas retailers' sales tax
26       act and deposited in the state treasury and credited to the state general
27       fund during the preceding three 12 calendar months from the sale of
28       tickets to athletic playoff games sponsored or sanctioned by the Kansas
29       state high school activities association.
30             (b) Upon receipt of each certification under subsection (a), the di-
31       rector of accounts and reports shall transfer from the state general fund
32       to There is hereby established the Kansas sports hall of fame fund
33       in the state treasury which shall be administered by the state trea-
34       surer in accordance with this section. All moneys transferred to
35       the Kansas sports hall of fame fund pursuant to this section shall
36       be paid by the state treasurer to the Kansas all sports hall of fame
37       board of trustees and shall be deposited in the bank account desig-
38       nated pursuant to K.S.A. 74-2912 and amendments thereto for the sup-
39       port and benefit of the Kansas sports hall of fame an amount equal to the
40       amount so certified on each January 1, April 1, July 1 and October 1 as
41       specified in subsection (a). All transfers made pursuant to this section are
42       subject to reduction under K.S.A. 75-6704, and amendments thereto.
43             (c) All transfers made pursuant to this section are subject to

  1       reduction under K.S.A. 75-6704 and amendments thereto. All trans-
  2       fers made in accordance with the provisions of this section shall be con-
  3       sidered to be demand transfers from the state general fund.
  4        [Sec.  2. There is hereby created the special education support
  5       fund in the state treasury. All moneys credited to such fund under
  6       the provisions of this act or any other law shall be allocated and
  7       distributed to unified school districts for special education services
  8       aid. The director of accounts and reports shall transfer on July 1,
  9       2001, and each July 1 thereafter, from the state general fund to
10       the special education support fund the amount certified by the
11       commissioner of education as the difference in the amount nec-
12       essary to provide 90% funding for special education services aid
13       for the fiscal year commencing on such July 1 and the aggregate
14       amount appropriated for such fiscal year for special education
15       services aid by acts enacted during the most recent regular session
16       of the legislature. All transfers are subject to reduction under
17       K.S.A. 75-6704, and amendments thereto. All transfers made in
18       accordance with the provisions of this section shall be considered
19       to be demand transfers from the state general fund.]
20        Sec.  2. [3.] This act shall take effect and be in force from and after
21       its publication in the statute book.
