10             AN  ACT concerning crimes and punishment; relating to unlawful sexual
11             relations by a person of authority.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. (a) Unlawful sexual relations by a person of authority is
15       engaging in consensual sexual intercourse, lewd fondling or touching, or
16       sodomy with a person 16 or 17 years of age who is not married to the
17       offender, if the offender is a person of authority and the person with
18       whom the offender is engaging in consensual sexual intercourse, lewd
19       fondling or touching, or sodomy is a person 16 or 17 years of age.
20             (b) For purposes of this section:
21             (1) "Person of authority" means:
22             (A) Persons who perform school services as classroom teachers, ad-
23       ministrators, supervisors, librarians, nurses, clerks, janitors or in any other
24       full-time capacity in a school;
25             (B) law enforcement officers; or
26             (C) firefighters.
27             (2) "School" means any public or nonpublic school maintaining any
28       or all of the grades nine through 12.
29             (c) Unlawful sexual relations by a person of authority is a severity
30       level 10 person felony.
31             (d) This section shall be part of and supplemental to the Kansas crim-
32       inal code.
33        Sec.  2. This act shall take effect and be in force from and after its
34       publication in the statute book.
