  9             A  PROPOSITION to amend section 3 of article 6 of the constitution of
10             the state of Kansas, relating to the state board of regents.

14             Be it resolved by the Legislature of the State of Kansas, two-thirds of the
15             members elected (or appointed) and qualified to the Senate and two-
16             thirds of the members elected (or appointed) and qualified to the House
17             of Representatives concurring therein:
18                   Section  1. The following proposition to amend the constitution of the
19       state of Kansas shall be submitted to the qualified electors of the state
20       for their approval or rejection: Section 3 of article 6 of the constitution
21       of the state of Kansas is hereby amended to read as follows:
22       "§  3. Members of state board of education and state board of
23             regents. (a) There shall be ten members of the state board of ed-
24             ucation with overlapping terms as the legislature may prescribe. The
25             legislature shall make provision for ten member districts, each com-
26             prised of four contiguous senatorial districts. The electors of each
27             member district shall elect one person residing in the district as a
28             member of the board. The legislature shall prescribe the manner
29             in which vacancies occurring on the board shall be filled.
30                   (b) There shall be the number of members of the state board of
31       regents shall have nine members with overlapping terms as the legis-
32       lature may prescribe. Members shall be appointed by the governor,
33       subject to confirmation by the senate. At least one member shall be
34       appointed from each congressional district with the remaining mem-
35       bers appointed at large,; however, no two members shall reside in the
36       same county at the time of their appointment. Vacancies occurring on
37       the board shall be filled by appointment by the governor as provided
38       by law.
39             (c) Subsequent redistricting shall not disqualify any member of
40       either board from service for the remainder of his the member's term.
41       Any member of either board may be removed from office for cause as
42       may be provided by law."
43             Sec.  2. The following statement shall be printed on the ballot with
44       the amendment as a whole:
45             "Explanatory statement. The constitution provides that the state

  1                   board of regents shall be composed of nine members. The pur-
  2                   pose of this amendment is to allow the legislature to prescribe
  3                   the numerical composition of the board of regents.
  4                   "A vote for this amendment would remove the provision in the
  5                   constitution that requires the state board of regents to be com-
  6                   posed of nine members and would allow the legislature to pro-
  7                   vide for the number of members composing the board of
  8                   regents.
  9                   "A vote against this amendment favors retaining a nine-member
10                   board of regents."
11                   Sec.  3. This resolution, if approved by two-thirds of the members
12       elected (or appointed) and qualified to the Senate, and two-thirds of the
13       members elected (or appointed) and qualified to the House of Repre-
14       sentatives shall be entered on the journals, together with the yeas and
15       nays. The secretary of state shall cause this resolution to be published as
16       provided by law and shall cause the proposed amendment to be submitted
17       to the electors of the state at the general election in the year 2000 unless
18       a special election is called at a sooner date by concurrent resolution of
19       the legislature, in which case it shall be submitted to the electors of the
20       state at the special election.
