10             AN  ACT concerning funeral processions; relating to the regulation
11             thereof; amending K.S.A. 8-1729 and K.S.A. 1998 Supp. 8-2118 and
12             8-2204 and repealing the existing sections.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             New Section  1. As used in sections 1 through 6:
16             (a) "Funeral director" shall have the same meaning as ascribed to
17       that term in K.S.A. 65-1713, and amendments thereto.
18             (b) "Funeral establishment" shall have the same meaning as ascribed
19       to that term in K.S.A. 65-1713a, and amendments thereto.
20             (c) "Funeral procession" means two or more vehicles accompanying
21       the body of a deceased person, or traveling to the church, chapel or other
22       location at which the funeral service is to be held, in the daylight hours,
23       including a funeral lead vehicle or a funeral escort vehicle.
24             (d) "Funeral lead vehicle" means any authorized law enforcement or
25       nonlaw enforcement motor vehicle properly equipped pursuant to section
26       2 or a funeral escort vehicle being used to lead and facilitate the move-
27       ment of a funeral procession. A funeral hearse may serve as a funeral lead
28       vehicle.
29             (e) "Funeral escort" means a person or entity that provides escort
30       services for funeral processions, including law enforcement personnel and
31       agencies.
32             (f) "Funeral escort vehicle" means any motor vehicle that is properly
33       equipped pursuant to section 2 and which escorts a funeral procession.
34             New Sec.  2. (a) All nonlaw enforcement funeral escort vehicles and
35       funeral lead vehicles shall be equipped with at least one rotating or os-
36       cillating lamp exhibiting a purple or amber light or lens visible under
37       normal atmospheric conditions for a distance of 500 feet from the front
38       of the vehicle. Flashing purple lights may be used only when such vehicles
39       are used in a funeral procession.
40             (b) Any law enforcement funeral escort vehicle may be equipped as
41       provided in K.S.A. 8-1720, and amendments thereto, or with purple or
42       amber flashing lights as provided in subsection (a).
43             New Sec.  3. (a) Notwithstanding any provision of state law or local
44       ordinance relating to traffic control devices or right-of-way provisions,
45       pedestrians and operators of all vehicles, except as stated in subsection
46       (c), shall yield the right-of-way to any vehicle which is part of a funeral
47       procession being led by a funeral escort vehicle or a funeral lead vehicle.
48             (b) Except as provided in subsection (c), when the funeral lead ve-
49       hicle lawfully enters an intersection, either by reason of a traffic control
50       device or at the direction of law enforcement personnel, the remaining
51       vehicles in the funeral procession may follow such funeral lead vehicle
52       through the intersection regardless of any traffic control devices or right-
53       of-way provisions prescribed by state or local law.
54             (c) Funeral processions shall have the right-of-way at intersections
55       regardless of traffic control devices, subject to the following conditions
56       and exceptions:
57             (1) Operators of vehicles in a funeral procession shall yield the right-
58       of-way to an approaching authorized emergency vehicle, as defined in
59       K.S.A. 8-1404, and amendments thereto, giving an audible or visible
60       signal;
61             (2) operators of vehicles in a funeral procession shall yield the right-
62       of-way when directed to do so by a police officer; and
63             (3) operators of vehicles in a funeral procession must exercise due
64       care when participating in a funeral procession and avoid colliding with
65       any other vehicle or pedestrian. Operators of vehicles in a funeral pro-
66       cession shall comply with the provisions of K.S.A. 8-1535, and amend-
67       ments thereto.; and
68             (4) an operator of a vehicle in a funeral procession shall not
69       have the right-of-way at an intersection, regardless of traffic control
70       devices, if the vehicle is more than 300 feet behind the immediately
71       preceding vehicle in the funeral procession.
72             New Sec.  4. (a) All vehicles comprising a funeral procession shall
73       follow the preceding vehicle in the funeral procession as closely as is
74       practical and safe.
75             (b) Any ordinance, law or regulation stating that motor vehicles shall
76       be operated to allow sufficient space enabling any other vehicle to enter
77       and occupy such space without danger shall not be applicable to vehicles
78       in a funeral procession.
79             (c) Each vehicle which is part of a funeral procession shall have its
80       headlights, either high or low beam, and tail lights lighted and may also
81       use the flashing hazard lights if the vehicle is so equipped.
82             New Sec.  5. Nothing in sections 1 through 4 of this act shall be con-
83       strued to prohibit any city or county from requiring:
84             (a) A law enforcement or nonlaw enforcement funeral lead vehicle
85       or funeral escort for a funeral procession and may require prior notice of
86       a planned funeral procession to the city police department or office of
87       the sheriff; or
88             (b) compliance with any other city or county traffic law, not in conflict
89       with the provisions of this section.
90             New Sec.  6. Liability for any death, personal injury or property dam-
91       age suffered by any person on or after July 1, 1999, which arises out of a
92       funeral procession shall not be imposed upon the funeral director or fu-
93       neral establishment or their employees or agents unless such death, per-
94       sonal injury or property damage results from the negligent or intentional
95       act of the funeral director or funeral establishment or their employee or
96       agent.
97             Sec.  7. K.S.A. 8-1729 is hereby amended to read as follows: 8-1729.
98       (a) During the times specified in K.S.A. 8-1703, and amendments thereto,
99       any lighted lamp or illuminating device upon a motor vehicle, other than
100       head lamps, spot lamps, auxiliary lamps, flashing turn signals, vehicular
101       hazard warning lamps and school bus warning lamps, which projects a
102       beam of light of an intensity greater than three hundred (300) 300 can-
103       dlepower shall be so directed that no part of the high intensity portion of
104       the beam will strike the level of the roadway on which the vehicle stands
105       at a distance of more than seventy-five (75) 75 feet from the vehicle.
106             (b) Except as required or permitted in K.S.A. 8-1720 and 8-1730, and
107       any amendments thereto, no person shall drive or move any vehicle or
108       equipment upon any highway with any lamp or device capable of dis-
109       playing a red light visible from directly in front of the center thereof, nor
110       shall any vehicle or equipment upon any highway have any lamp or device
111       displaying any color of light visible from directly in front of the center
112       thereof except:
113             (1) White or amber or any shade of color between white and amber;
114       or
115             (2) as provided in section 2.
116             (c) Flashing lights are prohibited except as authorized or required in
117       K.S.A. 8-1717, 8-1720, 8-1721, 8-1722, 8-1723(e), 8-1730, 8-1730a and
118       8-1731, and any amendments thereto or as provided in section 2.
119             (d) The flashing lights described in K.S.A. 8-1720, 8-1730 and 8-
120       1730a, and any amendments thereto, shall not be used on any vehicle
121       other than a school bus, church bus or day care program bus, as defined
122       in K.S.A. 8-1730a, and amendments thereto, or an authorized emergency
123       vehicle.
124             (e) All lighting devices and reflectors mounted on the rear of any
125       vehicle shall display or reflect a red color, except the stop light or other
126       signal device, which may be red, amber or yellow, and except that the
127       light illuminating the license plate shall be white and the light emitted by
128       a back-up lamp shall be white or amber.
129             (f) Flashing purple lights shall be used only as provided in sections 1
130       through 6.
131             Sec.  8. K.S.A. 1998 Supp. 8-2118 is hereby amended to read as fol-
132       lows: 8-2118. (a) A person charged with a traffic infraction shall, except
133       as provided in subsection (b), appear at the place and time specified in
134       the notice to appear. If the person enters an appearance, waives right to
135       trial, pleads guilty or no contest, the fine shall be no greater than that
136       specified in the uniform fine schedule in subsection (c) and court costs
137       shall be taxed as provided by law.
138             (b) Prior to the time specified in the notice to appear, a person
139       charged with a traffic infraction may enter a written appearance, waive
140       right to trial, plead guilty or no contest and pay the fine for the violation
141       as specified in the uniform fine schedule in subsection (c) and court costs
142       provided by law. Payment may be made by mail or in person and may be
143       by personal check. The traffic citation shall not have been complied with
144       if a check is not honored for any reason, or if the fine and court costs are
145       not paid in full. When a person charged with a traffic infraction makes
146       payment without executing a written waiver of right to trial and plea of
147       guilty or no contest, the payment shall be deemed such an appearance,
148       waiver of right to trial and plea of no contest.
149             (c) The following uniform fine schedule shall apply uniformly
150       throughout the state but shall not limit the fine which may be imposed
151       following a court appearance, except an appearance made for the purpose
152       of pleading and payment as permitted by subsection (a). The description
153       of offense contained in the following uniform fine schedule is for refer-
154       ence only and is not a legal definition.

298             (d) Traffic offenses classified as traffic infractions by this section shall
299       be classified as ordinance traffic infractions by those cities adopting
300       ordinances prohibiting the same offenses. A schedule of fines for all
301       ordinance traffic infractions shall be established by the municipal judge
302       in the manner prescribed by K.S.A. 12-4305 and amendments thereto.
303       Such fines may vary from those contained in the uniform fine schedule
304       contained in subsection (c).
305             (e) Fines listed in the uniform fine schedule contained in subsection
306       (c) shall be doubled if a person is convicted of a traffic infraction, which
307       is defined as a moving violation in accordance with rules and regulations
308       adopted pursuant to K.S.A. 8-249, and amendments thereto, committed
309       within any road construction zone as defined in K.S.A. 1998 Supp. 8-
310       1458a, and amendments thereto.
311             Sec.  9. K.S.A. 1998 Supp. 8-2204 is hereby amended to read as
312       follows: 8-2204. This act shall be known and may be cited as the uniform
313       act regulating traffic on highways. The uniform act regulating traffic on
314       highways includes K.S.A. 1998 Supp. 8-1560a through 8-1560d; all
315       sections located in articles 10 and 14 through 22 of chapter 8 of Kansas
316       Statutes Annotated; K.S.A. 8-1,129, 8-1,130a, 8-1428a, 8-1742a, 8-2118
317       and K.S.A. 1998 Supp. 8-1599, and amendments thereto, and sections 1
318       through 6 of this act
319       Sec.  10. K.S.A. 8-1729 and K.S.A. 1998 Supp. 8-2118 and 8-2204 are
320       hereby repealed.
321        Sec.  11. This act shall take effect and be in force from and after its
322       publication in the statute book.
