11             AN ACT making and concerning appropriations for the fiscal years ending
12             June 30, 1999, June 30, 2000, and June 30, 2001; authorizing certain
13             transfers and fees, imposing certain restrictions and limitations and
14             directing or authorizing certain receipts, disbursements, capital im-
15             provements and acts incidental to the foregoing.
16      
17       Be it enacted by the Legislature of the State of Kansas:
18             Section 1. (a) For the fiscal years ending June 30, 1999, June 30, 2000,
19       and June 30, 2001, appropriations are hereby made, restrictions and lim-
20       itations are hereby imposed, and transfers, fees, receipts, disbursements,
21       and acts incidental to the foregoing are hereby directed or authorized as
22       provided in this act.
23        (b) The agencies named in this act are hereby authorized to initiate
24       and complete the capital improvement projects specified and authorized
25       by this act or for which appropriations are made by this act, subject to
26       the restrictions and limitations imposed by this act.
27        (c) This act shall be known and may be cited as the omnibus appro-
28       priation act of 1999 and shall constitute the omnibus reconciliation spend-
29       ing limit bill for the 1999 regular session of the legislature for purposes
30       of subsection (a) of K.S.A. 75-6702 and amendments thereto.
31        (d) The appropriations made by this act shall not be subject to the
32       provisions of K.S.A. 46-155 and amendments thereto.
33        Sec. 2.
34      
DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
35        (a) There is appropriated for the above agency from the state general
36       fund for the fiscal year or years specified, the following:
37       Community based services
38       For the fiscal year ending June 30, 2000 $1,200,000
39       Youth services aid and assistance
40       For the fiscal year ending June 30, 1999 $6,428,207
41       For the fiscal year ending June 30, 2000 $4,670,000

10        (b) On the effective date of this act, of the $1,849,723 appropriated for
11       the above agency for the fiscal year ending June 30, 1999, by section
12       116(a) of 1999 Senate Bill No. 325 from the state general fund in the
13       mental health and retardation services aid and assistance and state insti-
14       tutions operations account, the sum of $454,938 is hereby lapsed.
15        (c) On the effective date of this act, of the $49,982,374 appropriated
16       for the above agency for the fiscal year ending June 30, 1999, by section
17       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
18       general fund in the cash assistance account, the sum of $190,000 is hereby
19       lapsed.
20        (d) On July 1, 1999, of the $53,328,276 appropriated for the above
21       agency for the fiscal year ending June 30, 2000, by section 55(a) of 1999
22       Senate Bill No. 325 from the state general fund in the cash assistance
23       account, the sum of $190,000 is hereby lapsed.
24        (e) In addition to the other purposes for which expenditures may be
25       made by the above agency from the children's health care programs fund
26       for fiscal year 2000, expenditures may be made by the above agency from
27       the children's health care programs fund for fiscal year 2000 for the fol-
28       lowing specified purposes subject to the expenditure limitations pre-
29       scribed therefor:
30       Children's health care programs fund--home and community based services for mental retardation $2,000,000
31       Provided, That all expenditures by the above agency from the children's
32       health care programs fund for fiscal year 2000 from the children's health
33       care programs fund--home and community based services for mental
34       retardation account shall be in addition to any expenditure limitation im-
35       posed on the children's health care programs fund for fiscal year 2000[:
36       Provided further, That expenditures from this account shall be made
37       to serve persons known to have applied for and been determined to
38       need community developmental disability services: And provided
39       further, That such expenditures shall be managed so as to serve as
40       many persons as possible: And provided further, That such expendi-
41       tures shall not exceed this amount when serving persons for a full
42       fiscal year].

1       Children's health care programs fund--home and community based services for physically disabled $1,000,000
  2       Provided, That all expenditures by the above agency from the children's
  3       health care programs fund for fiscal year 2000 from the children's health
  4       care programs fund--home and community based services for physically
  5       disabled account shall be in addition to any expenditure limitation im-
  6       posed on the children's health care programs fund for fiscal year 2000.
  7        (f) On July 1, 1999, the $1,000,000 appropriated for the above agency
  8       for the fiscal year ending June 30, 2000, by section 55(n) of 1999 Senate
  9       Bill No. 325 from the children's health care programs fund in the chil-
10       dren's health care programs fund--CDDO rate reimbursement account,
11       is hereby lapsed.
12        (g) On July 1, 1999, of the $89,635,746 appropriated for the above
13       agency for the fiscal year ending June 30, 2000, by section 55(a) of 1999
14       Senate Bill No. 325 from the state general fund in the state operations
15       account, the sum of $38,701 is hereby lapsed.
16        (h) On July 1, 1999, the position limitation established by section 90(a)
17       of 1999 Senate Bill No. 325 for the department of social and rehabilitation
18       services is hereby decreased from 4,176.0 to 4,170166.5.
19        (i) On the effective date of this act, the amounts specified in section
20       120(c) of chapter 203 of the 1998 Session Laws of Kansas as being in-
21       cluded in the mental health and retardation services aid and assistance
22       and state institutions operations account of the state general fund for the
23       following institutions are hereby changed to the amounts specified, but
24       expenditures from the mental health and retardation services aid and
25       assistance and state institutions operations account of the state general
26       fund for any such institution shall not be limited to, or be required to be
27       made in, the amount listed for the institution, as follows: (1) The amount
28       for Kansas neurological institute is hereby decreased from $10,198,356
29       to $10,192,251; (2) the amount for Larned state hospital is hereby de-
30       creased from $8,677,519 to $7,823,934; (3) the amount for Osawatomie
31       state hospital is hereby decreased from $3,693,609 to $2,593,609; (4) the
32       amount for Parsons state hospital and training center is hereby increased
33       from $8,683,907 to $8,686,419; and (5) the amount for Rainbow mental
34       health facility is hereby decreased from $2,391,500 to $2,177,740.
35        (j) On the effective date of this act, the expenditure limitation estab-
36       lished by section 116(o) of 1999 Senate Bill No. 325 on the Larned state
37       hospital fee fund is hereby increased from $2,769,829 to $3,619,829.
38        (k) On the effective date of this act, the expenditure limitation estab-
39       lished by section 116(p) of 1999 Senate Bill No. 325 on the Osawatomie
40       state hospital fee fund is hereby increased from $3,152,948 to $4,252,948.
41        (l) On the effective date of this act, the expenditure limitation estab-
42       lished by section 116(r) of 1999 Senate Bill No. 325 on the Rainbow

  1       mental health facility fee fund is hereby increased from $1,036,361 to
  2       $1,236,361.
  3        (m) On July 1, 1999, the amounts specified in section 55(c) of 1999
  4       Senate Bill No. 325 as being included in the mental health and retardation
  5       services aid and assistance and state institutions operations account of the
  6       state general fund for the following institutions are hereby changed to
  7       the amounts specified, but expenditures from the mental health and re-
  8       tardation services aid and assistance and state institutions operations ac-
  9       count of the state general fund for any such institution shall not be limited
10       to, or be required to be made in, the amount listed for the institution, as
11       follows: (1) The amount for Kansas neurological institute is hereby de-
12       creased from $7,931,823 to $7,897,451; (2) the amount for Larned state
13       hospital is hereby increased from $11,768,273 to $11,792,481; (3) the
14       amount for Osawatomie state hospital is hereby decreased from
15       $5,988,178 to $5,971,632; (4) the amount for Parsons state hospital and
16       training center is hereby increased from $5,943,156 to $5,946,192; and
17       (5) the amount for Rainbow mental health facility is hereby decreased
18       from $1,583,476 to $1,575,691.
19        (n) On July 1, 1999, the position limitations established by section 90(a)
20       of 1999 Senate Bill No. 325 for the following agencies are hereby in-
21       creased or decreased, as specified, to the position limitations specified for
22       such agencies: (1) The position limitation for Larned state hospital is
23       hereby decreased from 767.6 to 766.6; (2) the position limitation for Os-
24       awatomie state hospital is hereby decreased from 483.4 to 482.4; (3) the
25       position limitation for Parsons state hospital and training center is hereby
26       decreased from 522.0 to 521.0; and (4) the position limitation for Rainbow
27       mental health facility is hereby decreased from 137.4 to 136.4.
28        (o) In addition to the other purposes for which expenditures may be
29       made by the department of social and rehabilitation services from any
30       moneys appropriated from the state general fund or any special revenue
31       fund for the fiscal year ending June 30, 2000, as authorized by this or
32       other appropriation act of the 1999 regular session of the legislature,
33       expenditures shall be made by the department of social and rehabilitation
34       services from any such moneys appropriated for fiscal year 2000 for the
35       receipt, crediting and disbursement of moneys received by the depart-
36       ment of social and rehabilitation services for payments of support pur-
37       suant to a rule or administrative order issued by the Kansas supreme
38       court, which is hereby authorized to be issued by the Kansas supreme
39       court, directing payments of support, which are made pursuant to any
40       court order entered in this state regardless of the date of the order, to be
41       made to a central unit for the collection and disbursement of support
42       payments, notwithstanding the provisions of any statute to the contrary.

  1        Sec. 3.
  2      
DEPARTMENT ON AGING
  3        (a) There is appropriated for the above agency from the state general
  4       fund for the fiscal year or years specified, the following:
  5       Administration
6       For the fiscal year ending June 30, 2000 $423,250
  7       Long term care
8       For the fiscal year ending June 30, 1999 $200,000
9       For the fiscal year ending June 30, 2000 $840,000
10       Nursing facilities quality enhancement wage pass-through pursuant to
11       1999 Senate Bill No. 126
12       For the fiscal year ending June 30, 2000 $1,725,000
13        (b) On or before July 15, 1999, and on the 15th day of each month
14       thereafter during the fiscal year ending June 30, 2000, the secretary of
15       aging shall certify to the director of the budget the total amount of moneys
16       which were received by the department on aging during the preceding
17       month from the federal government and which were deposited in the
18       state treasury to the credit of the medicaid fund--federal. During the
19       fiscal year ending June 30, 2000, after receiving one or more certifications
20       from the secretary of aging under this subsection, the director of the
21       budget may certify an amount or amounts to the director of accounts and
22       reports to be transferred from the medicaid fund--federal of the de-
23       partment on aging to the state general fund for the purpose of reim-
24       bursing the state general fund for the amount appropriated for the de-
25       partment on aging from the state general fund in the administration
26       account. Upon receiving each such certification from the director of the
27       budget, the director of accounts and reports shall transfer the amount or
28       amounts certified from the medicaid fund--federal of the department on
29       aging to the state general fund on the dates specified by the director of
30       the budget.
31        (c) On July 1, 1999, the position limitation established by section 90(a)
32       of 1999 Senate Bill No. 325 for the department on aging is hereby in-
33       creased from 155.8 to 157.8.
34        Sec. 4.
35      
DEPARTMENT OF TRANSPORTATION
36        (a) On the effective date of this act, the expenditure limitation estab-
37       lished by section 136(a) of 1999 Senate Bill No. 325 on the agency op-
38       erations account of the state highway fund is hereby decreased from
39       $198,435,474 to $198,348,984.
40        (b) On July 1, 1999, the position limitation established by section 90(a)
41       of 1999 Senate Bill No. 325 for the department of transportation is hereby
42       decreased creased] from 3,118.5 to 3,111.5 [3,219.5].
43        (c) On July 1, 1999, the expenditure limitation established by section

  1       89(b) of 1999 Senate Bill No. 325 on the agency operations account of
  2       the state highway fund is hereby decreased creased] from
  3       $205,226,194 to $204,930,379 [$212,487,075].
  4        [(d) There is appropriated for the above agency from the follow-
  5       ing special revenue fund or funds for the fiscal year or years spec-
  6       ified, all moneys now or hereafter lawfully credited to and available
  7       in such fund or funds, except that expenditures other than refunds
  8       authorized by law shall not exceed the following:
  9       [Transportation revolving fund
10       [For the fiscal year ending June 30, 2000 No limit
11       [Highway bond proceeds fund
12       [For the fiscal year ending June 30, 2000 No limit
13       [Coordinated public transportation assistance fund

15        [(e) On July 1, 1999, the expenditure limitation established by
16       section 89(b) of 1999 Senate Bill No. 325 on the payments for city
17       connecting links account of the state highway fund is hereby in-
18       creased from $2,240,000 to No limit.]
19        Sec. 5.
20      
KANSAS LOTTERY
21        (a) The director of accounts and reports shall not make any transfers
22       from the lottery operating fund of the Kansas lottery to the state general
23       fund that are prescribed to be made by section 45(e) of 1999 Senate Bill
24       No. 325 and the executive director shall not make any of the calculations,
25       determinations and certifications that are prescribed to be made by sec-
26       tion 45(e) of 1999 Senate Bill No. 325: Provided, That, in lieu thereof,
27       the director of accounts and reports shall make the transfers from the
28       lottery operating fund of the Kansas lottery to the state general fund that
29       are prescribed to be made by subsection (b) of this section and the ex-
30       ecutive director of the Kansas lottery shall perform the calculations, de-
31       terminations and certifications prescribed by subsection (b) of this sec-
32       tion.
33        (b) On June 15, 2000, the executive director of the Kansas lottery shall
34       determine whether the total of all transfers during the fiscal year ending
35       June 30, 2000, from the lottery operating fund to the state gaming rev-
36       enues fund as of June 15, 2000, equals $59,400,000 or more: Provided,
37       That, if the total amount of such transfers is less than $59,400,000 as of
38       June 15, 2000, then the executive director of the Kansas lottery shall
39       compute the difference between the projected total amount of such trans-
40       fers during fiscal year 2000 and the actual total of the transfers as of June
41       15, 2000, and, on June 15, 2000, the executive director of the Kansas
42       lottery shall certify to the director of accounts and reports the amount
43       equal to the difference between projected and actual total transfers so

  1       computed: Provided further, That, on or after receiving such certification
  2       and not later than June 20, 2000, the director of accounts and reports
  3       shall transfer the amount certified from the lottery operating fund to the
  4       state general fund for the purpose of enhancing revenues and providing
  5       additional moneys for the state general fund if lottery sales fall below a
  6       projected total of $198,000,000 during the fiscal year 2000 period for
  7       determination of lottery sales and the total of the actual transfers to the
  8       state gaming revenues fund do not equal or exceed the projected total of
  9       $59,400,000 during fiscal year 2000 by June 15, 2000: Provided, however,
10       That, notwithstanding the amount certified by the executive director of
11       the Kansas lottery to the director of accounts and reports pursuant to this
12       subsection, the amount transferred from the lottery operating fund to the
13       state general fund shall not exceed $732,560.
14        Sec. 6.
15      
KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
16        (a) On the effective date of this act, the expenditure limitation estab-
17       lished by section 137(a) of 1999 Senate Bill No. 325 on expenditures from
18       the Kansas public employees retirement fund for the technology project
19       is hereby decreased from $2,250,000 to $398,745.
20        (b) On July 1, 1999, the expenditure limitation established by section
21       5(e) of chapter 202 of the 1998 Session Laws of Kansas on expenditures
22       from the Kansas public employees retirement fund for the technology
23       project is hereby increased from $600,000 to $2,451,255.
24        (c) There is appropriated for the above agency from the following spe-
25       cial revenue fund or funds for the fiscal year or years specified, all moneys
26       now or hereafter lawfully credited to and available in such fund or funds,
27       except that expenditures other than refunds authorized by law shall not
28       exceed the following:
29       Group insurance reserve fund
30       For the fiscal year ending June 30, 2000 No limit
31       Optional death benefit plan reserve fund
32       For the fiscal year ending June 30, 2000 No limit
33        (d) On July 1, 1999, or as soon as moneys are available therefor, the
34       director of accounts and reports shall transfer $20,000,000 from the group
35       insurance reserve fund of the above agency to the Kansas public employ-
36       ees retirement fund for the purpose of paying a portion of the unfunded
37       actuarial liability as of June 30, 1998, of the Kansas public employees
38       retirement system, including any unfunded liability attributable to the
39       1998 cost-of-living adjustment enacted by the 1998 regular session of the
40       legislature and published as K.S.A. 1998 Supp. 74-4950i: Provided, That,
41       based on information reported by the actuary employed of the board of
42       trustees of the Kansas public employees retirement system and by the
43       executive secretary of the board of trustees, a portion of the $51,100,000

  1       identified by the actuary as excess funding in the group insurance reserve
  2       fund on June 30, 1998, may be transferred from the group insurance
  3       reserve fund to the Kansas public employees retirement fund to be used
  4       as assets of such fund: Provided, however, That, of the $51,100,000 that
  5       was identified by the actuary as excess funding, the amount that could be
  6       transferred from the group insurance reserve fund to the Kansas public
  7       employees retirement fund, in the opinion of the actuary and the exec-
  8       utive secretary, should not exceed $23,000,000: Provided further, That,
  9       of such excess reserve amount of $23,000,000 identified by the actuary,
10       it is hereby declared that it is appropriate that $20,000,000 shall be trans-
11       ferred in fiscal year 2000 from the group insurance reserve fund to the
12       Kansas public employees retirement fund to be used as assets of such
13       fund.
14        Sec. 7.

DEPARTMENT OF EDUCATION
16        (a) There is appropriated for the above agency from the state general
17       fund for the fiscal year or years specified, the following:
18       School district juvenile detention facilities and Flint Hills job corps center
19       grants
20       For the fiscal year ending June 30, 1999 $263,000
21       For the fiscal year ending June 30, 2000 $949,490
22       Communities in schools
23       For the fiscal year ending June 30, 2000 $125,000
24       Kansas office for community service grant
25       For the fiscal year ending June 30, 2000 $88,000
26        (b) On July 1, 1999, of the 1,763,838,086 appropriated for the above
27       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
28       Senate Bill No. 325 from the state general fund in the general state aid
29       account, the sum of $8,933,000 is hereby lapsed.
30        (c) On July 1, 1999, of the $76,890,000 appropriated for the above
31       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
32       Senate Bill No. 325 from the state general fund in the supplemental
33       general state aid account, the sum of $321,000 is hereby lapsed.
34        (d) On July 1, 1999, of the $91,696,756 appropriated for the above
35       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
36       Senate Bill No. 325 from the state general fund in the KPERS--employer
37       contributions account, the sum of $240,435 is hereby lapsed.
38        (e) On July 1, 1999, the expenditure limitation established by section
39       57(a) of 1999 Senate Bill No. 325 on the expenditures from the reappro-
40       priated balance in the KPERS--employer contributions account is hereby
41       increased from $733,969 to $1,233,969.
42        (f) On July 1, 1999, the matching requirement imposed on school dis-
43       tricts by section 57(a) of 1999 Senate Bill No. 325 for purposes of match-

  1       ing grants from the state general fund for the parent education program
  2       is hereby increased from an amount which is equal to not less than 50%
  3       of the grant to an amount that is equal to not less than 75% of the grant.
  4        (g) All expenditures from the children's health care programs fund--
  5       parent education program account of the children's health care programs
  6       fund for the fiscal year ending June 30, 2000, as prescribed in section
  7       57(g) of 1999 Senate Bill No. 325, shall be matched by the school district
  8       receiving the grant in an amount which is equal to not less than 75% of
  9       the grant.
10        (h) On July 1, 1999, the limitation imposed by section 57(a) of 1999
11       Senate Bill No. 325 on the amount of moneys in the unencumbered
12       balance in the general state aid account of the state general fund that, in
13       excess of which, an amount of not to exceed $2,000,000 shall be trans-
14       ferred to the inservice education aid account of the state general fund of
15       the department of education to be used to fund approved inservice ed-
16       ucation programs as authorized by K.S.A. 72-9601 et seq., and amend-
17       ments thereto, is hereby increased from $29,750,914 to $37,795,914.
18        (i) Expenditures made by the department of education from the school
19       district capital improvements fund as provided for in section 57(b) of 1999
20       Senate Bill No. 325 shall only be made for the payment of general obli-
21       gation bonds approved by the voters under the authority of K.S.A. 72-
22       6761 and amendments thereto.
23        Sec. 8.

STATE BOARD OF INDIGENTS' DEFENSE SERVICES
25        (a) There is appropriated for the above agency from the state general
26       fund for the fiscal year or years specified, the following:
27       Operating expenditures
28       For the fiscal year ending June 30, 2000 $292,107
29        (b) In addition to the other purposes for which expenditures may be
30       made by the state board of indigents' defense services from the indigents'
31       defense services fund for the fiscal year ending June 30, 2000, as author-
32       ized by section 35(b) of 1999 Senate Bill No. 325, expenditures may be
33       made by the state board of indigents' defense services for fiscal year 2000
34       from the indigents' defense services fund for fiscal year 2000, for salaries
35       and wages of attorneys who are officers or employees of the state board
36       of indigents' defense services.
37        Sec. 9.
38      
DEPARTMENT OF REVENUE
39        (a) On the effective date of this act, the expenditure limitation estab-
40       lished by section 110(a) of 1999 Senate Bill No. 325 on the division of
41       vehicles operating fund is hereby increased from $30,624,572 to
42       $30,649,572.
43        (b) On July 1, 1999, of the $31,051,780 appropriated for the above

  1       agency for the fiscal year ending June 30, 2000, by section 44(a) of 1999
  2       Senate Bill No. 325 from the state general fund in the operating expend-
  3       itures account, the sum of $16,855 is hereby lapsed.
  4        (c) On July 1, 1999, the position limitation established by section 90(a)
  5       of 1999 Senate Bill No. 325 for the department of revenue is hereby
  6       decreased from 1,182.5 to 1,179.5.
  7        (d) In addition to the other purposes for which expenditures may be
  8       made by the above agency from the VIPS/CAMA technology hardware
  9       fund for the fiscal year ending June 30, 2000, as authorized by section
10       44(b) of 1999 Senate Bill No. 325, expenditures may be made from the
11       VIPS/CAMA technology hardware fund for fiscal year 2000 for computer
12       programming and other costs necessary to implement 1999 House Bill
13       No. 2035: Provided, That expenditures for such purpose from the VIPS/
14       CAMA technology hardware fund for fiscal year 2000 shall not exceed
15       $55,428.
16        (e) On July 1, 1999, the expenditure limitation established by section
17       44(b) of 1999 Senate Bill No. 325 on the salaries and wages account of
18       the division of vehicles operating fund is hereby decreased from
19       $18,955,496 to $17,144,750.
20        Sec. 10.
21      
DEPARTMENT OF ADMINISTRATION
22        (a) On July 1, 1999, the position limitation established by section 90(a)
23       of 1999 Senate Bill No. 325 for the department of administration is
24       hereby increased from 884.4 to 888.4.
25        (b) There is appropriated for the above agency from the following spe-
26       cial revenue fund or funds for the fiscal year or years specified, all moneys
27       now or hereafter lawfully credited to and available in such fund or funds,
28       except that expenditures other than refunds authorized by law shall not
29       exceed the following:
30       Public school districts benefit fund
31       For the fiscal year ending June 30, 2000 No limit
32        (c) During the fiscal years ending June 30, 1999, and June 30, 2000,
33       upon certification by the secretary of administration to the director of
34       accounts and reports that the unencumbered balance in the construction
35       defects recovery fund is insufficient to pay an amount that is necessary
36       to finance expenses related to efforts by the state of Kansas to recover
37       damages incidental to construction defects on capital projects involving
38       state facilities, the director of accounts and reports shall transfer an
39       amount equal to the insufficient amount from the architectural services
40       recovery fund to the construction defects recovery fund: Provided, That
41       the total of all such amounts transferred pursuant to this subsection dur-

24       tered into with any group performing, promoting, referring for or
25       educating in favor of abortion: And provided further, That a not-for-
26       profit organization awarded a contract under this proviso shall
27       match state moneys under this contract on the basis of a 50% match
28       from a not-for-profit organization and a 50% match from the de-
29       partment of health and environment: And provided further, That the
30       secretary of health and environment shall submit a report to the
31       legislature at the beginning of the regular session of the legislature
32       in 2000 on the results and outcomes of such pregnancy maintenance
33       programs: And provided further, That no part of the grant moneys
34       shall be used for any political purposes: And provided further, That
35       expenditures from the aid to local units account of the state general
36       fund for fiscal year 2000 for such purpose shall not exceed

  5        (g) During the fiscal year ending June 30, 2000, the superintendent of
  6       the Beloit juvenile correctional facility, upon the approval of the director
  7       of accounts and reports, shall transfer $1,000 from the Beloit juvenile
  8       correctional facility--canteen fund to the Beloit juvenile correctional fa-
  9       cility--patient benefit fund.
10        (h) During the fiscal year ending June 30, 2000, the commissioner of
11       juvenile justice, with the approval of the director of the budget, may
12       transfer any part of any item of appropriation for the fiscal year ending
13       June 30, 2000, from the state general fund for the juvenile justice au-
14       thority or any juvenile correctional facility or institution under the general
15       supervision and management of the commissioner of juvenile justice to
16       another item of appropriation for fiscal year 2000 from the state general
17       fund for the juvenile justice authority or any juvenile correctional facility
18       or institution under the general supervision and management of the com-
19       missioner of juvenile justice. The commissioner of juvenile justice shall
20       certify each such transfer to the director of accounts and reports and shall
21       transmit a copy of each such certification to the legislative research de-
22       partment.
23        (i) The following amounts are included in the facilities operations ac-
24       count of the state general fund for the fiscal year ending June 30, 2000,
25       for the following juvenile correctional facilities and institutions, but ex-
26       penditures from the facilities operations account shall not be limited to,
27       nor be required to be made in, the amount listed for the juvenile correc-
28       tional facility:

37       rectional facility to the juvenile justice federal fund of the juvenile justice
38       authority.
39        (k) In addition to the other purposes for which expenditures may be
40       made from the children's health care programs fund for the fiscal year
41       ending June 30, 2000, expenditures may be made by the above agency
42       from the children's health care programs fund for fiscal year 2000 for the
43       following specified purposes subject to the expenditure limitations pre-

18       to full-time, excluding seasonal and temporary positions, paid from ap-
19       propriations for fiscal year 2000 made in this or other appropriation act
20       of the 1999 regular session of the legislature for the juvenile justice au-
21       thority shall not exceed 609.0, except upon approval of the state finance
22       council.
23        (m) There is appropriated for the above agency from the state insti-
24       tutions building fund for the fiscal year ending June 30, 2000, for the
25       capital improvement project or projects specified as follows:

15       for, the director of accounts and reports shall transfer $72,000,000 from
16       the children's health care programs fund to the state general fund.
17        Sec. 48. (a) In accordance with appropriations for the fiscal year ending
18       June 30, 2000, made by this or other appropriation act of the 1999 regular
19       session of the legislature:
20        (1) The governor is hereby authorized and directed to modify the pay
21       plan for fiscal year 1999 in accordance with this subsection (a)(1) and to
22       adopt such pay plan as so modified. The existing pay plan for fiscal year
23       1999 shall be modified to provide for an increase of 1.0% in the pay rates
24       of such pay plan. The pay plan adopted by the governor under this sub-
25       section (a)(1) shall be the pay plan for the classified service under the
26       Kansas civil service act and shall be effective on the first day of the first
27       biweekly payroll period which is chargeable to the fiscal year ending June
28       30, 2000. Such pay plan shall be subject to modification and approval as
29       provided under K.S.A. 75-2938 and amendments thereto and to any en-
30       actment of the legislature applicable thereto.
31        (2) (A) The governor is hereby authorized and directed to modify or
32       authorize the modification of the salaries of state officers and employees
33       who are in the unclassified service under the Kansas civil service act and
34       whose salaries are subject to approval by the governor under K.S.A. 75-
35       2935b or 75-2935c and amendments thereto to provide for base salary
36       increases, to be effective on the first day of the first payroll period which
37       is chargeable to the fiscal year ending on June 30, 2000, and to be dis-
38       tributed on a merit basis from a merit salary increase pool, the average
39       of such increases shall not exceed 3.5% of the base salaries of such officers
40       and employees.
41        (B) Each elected state official of the executive branch of state govern-
42       ment, including the state board of education, and the Kansas technology
43       enterprise corporation, Kansas, Inc., the state board of regents and the

  1       board of trustees of the Kansas public employees retirement system, in
  2       each such official or board's discretion, are hereby authorized and di-
  3       rected to modify or to authorize the modification of the salaries of the
  4       state officers and employees of such official or board, who are in the
  5       unclassified service under the Kansas civil service act and whose salaries
  6       are not subject to approval by the governor under K.S.A. 75-2935b or 75-
  7       2935c and amendments thereto, to provide for base salary increases to
  8       be effective on the first day of the first payroll period which is chargeable
  9       to the fiscal year ending June 30, 2000, and to be distributed on a merit
10       basis from a merit salary increase pool, the average of such increases shall
11       not exceed 3.5% of the base salaries of such officers and employees of
12       such official or board. The provisions of this subsection (a)(2)(B) shall not
13       authorize or provide any salary increase for the governor, lieutenant gov-
14       ernor, secretary of state, state treasurer, commissioner of insurance, at-
15       torney general, or to any member of any state board, commission, council
16       or committee receiving per diem compensation as provided by statute.
17        (b) On and after June 13, 1999, in addition to the other purposes for
18       which expenditures may be made by the governor's department from the
19       governor's department account of the state general fund for the fiscal
20       year ending June 30, 2000, expenditures shall be made by the governor's
21       department from the governor's department account of the state general
22       fund for fiscal year 2001 for an additional amount of biweekly compen-
23       sation for the governor equal to the amount required to provide, along
24       with the amount of biweekly compensation otherwise payable, an aggre-
25       gate amount of compensation of $3,528.54 per biweekly pay period: Pro-
26       vided, That expenditures for such purpose shall be made in the same
27       manner and at the same times that biweekly compensation is payable to
28       the governor for the biweekly pay periods which commence on or after
29       June 13, 1999, and which are chargeable to fiscal year 2000.
30        (c) On and after June 13, 1999, in addition to the other purposes for
31       which expenditures may be made by the lieutenant governor from the
32       operations account of the state general fund for the fiscal year ending
33       June 30, 2000, expenditures shall be made by the lieutenant governor
34       from the operations account of the state general fund for fiscal year 2000
35       for an additional amount of biweekly compensation for the lieutenant
36       governor equal to the amount required to provide, along with the amount
37       of biweekly compensation otherwise payable, an aggregate amount of
38       compensation of $998.04 per biweekly pay period: Provided, That ex-
39       penditures for such purpose shall be made in the same manner and at
40       the same times that biweekly compensation is payable to the lieutenant
41       governor for the biweekly pay periods which commence on or after June
42       13, 1999, and which are chargeable to fiscal year 2000.
43        (d) On and after June 13, 1999, in addition to the other purposes for

  1       which expenditures may be made by the secretary of state from the op-
  2       erating expenditures account of the state general fund for the fiscal year
  3       ending June 30, 2000, expenditures shall be made by the secretary of
  4       state from the operating expenditures account of the state general fund
  5       for fiscal year 2000 for an additional amount of biweekly compensation
  6       for the secretary of state equal to the amount required to provide, along
  7       with the amount of biweekly compensation otherwise payable, an aggre-
  8       gate amount of compensation of $2,741.15 per biweekly pay period: Pro-
  9       vided, That expenditures for such purpose shall be made in the same
10       manner and at the same times that biweekly compensation is payable to
11       the secretary of state for the biweekly pay periods which commence on
12       or after June 13, 1999, and which are chargeable to fiscal year 2000.
13        (e) On and after June 13, 1999, in addition to the other purposes for
14       which expenditures may be made by the attorney general from the op-
15       erating expenditures account of the state general fund for the fiscal year
16       ending June 30, 2000, expenditures shall be made by the attorney general
17       from the operating expenditures account of the state general fund for
18       fiscal year 2000 for an additional amount of biweekly compensation for
19       the attorney general equal to the amount required to provide, along with
20       the amount of biweekly compensation otherwise payable, an aggregate
21       amount of compensation of $3,152.24 per biweekly pay period: Provided,
22       That expenditures for such purpose shall be made in the same manner
23       and at the same times that biweekly compensation is payable to the at-
24       torney general for the biweekly pay periods which commence on or after
25       June 13, 1999, and which are chargeable to fiscal year 2000.
26        (f) On and after June 13, 1999, in addition to the other purposes for
27       which expenditures may be made by the state treasurer from the oper-
28       ating expenditures account of the state general fund for the fiscal year
29       ending June 30, 2000, expenditures shall be made by the state treasurer
30       from the operating expenditures account of the state general fund for
31       fiscal year 2000 for an additional amount of biweekly compensation for
32       the state treasurer equal to the amount required to provide, along with
33       the amount of biweekly compensation otherwise payable, an aggregate
34       amount of compensation of $2,741.15 per biweekly pay period: Provided,
35       That expenditures for such purpose shall be made in the same manner
36       and at the same times that biweekly compensation is payable to the state
37       treasurer for the biweekly pay periods which commence on or after June
38       13, 1999, and which are chargeable to fiscal year 2000.
39        (g) On and after June 13, 1999, in addition to the other purposes for
40       which expenditures may be made by the insurance department from the
41       insurance department service regulation fund for the fiscal year ending
42       June 30, 2000, expenditures shall be made by the insurance department
43       from the insurance department service regulation fund for fiscal year

  1       2000 for an additional amount of biweekly compensation for the com-
  2       missioner of insurance equal to the amount required to provide, along
  3       with the amount of biweekly compensation otherwise payable, an aggre-
  4       gate amount of compensation of $2,741.15 per biweekly pay period: Pro-
  5       vided, That expenditures for such purpose shall be made in the same
  6       manner and at the same times that biweekly compensation is payable to
  7       the commissioner of insurance for the biweekly pay periods which com-
  8       mence on or after June 13, 1999, and which are chargeable to fiscal year
  9       2000.
10        (h) (1) In addition to the other purposes for which expenditures may
11       be made by each state agency from appropriations made for the fiscal
12       year ending June 30, 2000, expenditures shall be made by each state
13       agency from the appropriations made for fiscal year 2000 for an additional
14       amount of per diem compensation equal to the amount required to pro-
15       vide, along with the amount of per diem compensation otherwise payable,
16       an aggregate amount of compensation of $74.58 per calendar day for each
17       member of a board for any calendar day occurring on or after June 13,
18       1999, for which per diem compensation is payable to such member of a
19       board under K.S.A. 75-3212 or 75-3223 and amendments thereto at the
20       rate prescribed by subsection (a) of K.S.A. 46-137a and amendments
21       thereto: Provided, That expenditures for such purpose shall be made in
22       the same manner and at the same times that per diem compensation is
23       payable to such member of a board for the biweekly pay periods for which
24       such per diem compensation for calendar days occurring on or after June
25       13, 1999, is payable and which are chargeable to fiscal year 2000.
26        (2) As used in this subsection (h), (A) "state agency" means any state
27       agency of the executive branch of state government (i) which has appro-
28       priations made for the fiscal year ending June 30, 2000, by 1999 Senate
29       Bill No. 325, this act or any other appropriation act of the 1999 regular
30       session of the legislature, and (ii) which is, or which makes expenditures
31       for, any board; and
32        (B) "board" means any board, commission, committee, task force,
33       panel or other body in the executive branch of state government, includ-
34       ing any advisory body, having one or more members who are entitled to
35       receive per diem compensation for attendance at meetings of such body,
36       or attendance at meetings authorized by such body of a subcommittee or
37       other subsidiary group of such body, as provided in K.S.A. 75-3212 or
38       75-3223 and amendments thereto at the rate prescribed by subsection (a)
39       of K.S.A. 46-137a and amendments thereto.
40        (i) In addition to the other purposes for which expenditures may be
41       made by the Kansas turnpike authority for the period commencing June
42       13, 1999, and ending June 30, 2000, expenditures shall be made by the
43       Kansas turnpike authority for such period for an additional amount of per

  1       diem compensation equal to the amount required to provide, along with
  2       the amount of per diem compensation otherwise payable, an aggregate
  3       amount of compensation of $74.58 per calendar day for each member of
  4       the Kansas turnpike authority for any calendar day occurring on or after
  5       June 13, 1999, for which per diem compensation is payable to such mem-
  6       ber under K.S.A. 68-2003 and amendments thereto who is entitled, in
  7       accordance with K.S.A. 75-3223 and amendments thereto, to receive such
  8       per diem compensation as provided in K.S.A. 75-3212 and amendments
  9       thereto at the rate prescribed by subsection (a) of K.S.A. 46-137a and
10       amendments thereto: Provided, That expenditures for such purpose shall
11       be made in the same manner and at the same times that per diem com-
12       pensation is payable to such member of the Kansas turnpike authority for
13       the appropriate pay periods for which such per diem compensation for
14       calendar days occurring on or after June 13, 1999, and prior to July 1,
15       2000, is payable by the Kansas turnpike authority.
16        (j) In addition to the other purposes for which expenditures may be
17       made by the legislature from the operations (including official hospitality)
18       account of the state general fund for the fiscal year ending June 30, 2000,
19       expenditures shall be made by the legislature from the operations (in-
20       cluding official hospitality) account of the state general fund for fiscal year
21       2000 (1) for an additional amount of per diem compensation equal to the
22       amount required to provide, along with the amount of per diem com-
23       pensation otherwise payable, an aggregate amount of compensation of
24       $74.58 per calendar day for each member of the legislature for service at
25       the regular session or any special session of the legislature for any calendar
26       day occurring on or after June 13, 1999, and (2) for an additional amount
27       of per diem compensation equal to the amount required to provide, along
28       with the amount of per diem compensation otherwise payable, an aggre-
29       gate amount of compensation of $74.58 per calendar day for each mem-
30       ber of the legislature and for any other public officer or person for any
31       calendar day occurring on or after June 13, 1999, for which per diem
32       compensation is payable from appropriations for the legislature to such
33       member of the legislature, public officer or person under K.S.A. 75-3212
34       or 75-3223 and amendments thereto at the rate prescribed by subsection
35       (a) of K.S.A. 46-137a and amendments thereto: Provided, That expend-
36       itures for such purposes shall be made in the same manner and at the
37       same times that per diem compensation is payable to such members of
38       the legislature, public officials and persons for the biweekly pay periods
39       for which such per diem compensation for calendar days occurring on or
40       after June 13, 1999, is payable and which are chargeable to fiscal year
41       2000.
42        (k) On and after June 13, 1999, in addition to the other purposes for
43       which expenditures may be made by the legislature from the operations

  1       (including official hospitality) account of the state general fund for the
  2       fiscal year ending June 30, 2000, expenditures shall be made by the leg-
  3       islature from the operations (including official hospitality) account of the
  4       state general fund for fiscal year 2000 for an additional amount of bi-
  5       weekly compensation for the following legislative officers equal to the
  6       amount required to provide, along with the amount of biweekly compen-
  7       sation otherwise payable, an aggregate amount of compensation per bi-
  8       weekly pay period for such legislative officers as follows: (1)  For the
  9       president of the senate and the speaker of the house of representatives
10       equal to the amount required to provide an aggregate amount of $454.18
11       per biweekly pay period for services performed in connection with dis-
12       charging the duties assigned to the respective positions, (2) for the
13       speaker pro tem of the house of representatives, the vice president of the
14       senate, the assistant majority leaders of the senate and house of repre-
15       sentatives, and the assistant minority leaders of the senate and house of
16       representatives equal to the amount required to provide an aggregate
17       amount of $231.81 per biweekly pay period for services performed in
18       connection with discharging the duties assigned to the respective posi-
19       tions, (3) for the chairperson of the senate committee on ways and means
20       and the chairperson of the house of representatives committee on appro-
21       priations equal to the amount required to provide an aggregate amount
22       of $365.24 per biweekly pay period for services performed in connection
23       with discharging the duties assigned to the respective positions, (4) for
24       the majority leaders of the senate and house of representatives equal to
25       the amount required to provide an aggregate amount of $409.75 per bi-
26       weekly pay period for services performed in connection with discharging
27       the duties assigned to the respective positions, and (5) the minority lead-
28       ers of the senate and house of representatives equal to the amount re-
29       quired to provide an aggregate amount of $409.75 per biweekly pay pe-
30       riod for services performed in connection with discharging the duties
31       assigned to the respective positions: Provided, That expenditures for such
32       purpose shall be made in the same manner and at the same times that
33       biweekly compensation is payable to such legislative officers under K.S.A.
34       46-137b and amendments thereto for the biweekly pay periods which
35       commence on or after June 13, 1999, and which are chargeable to fiscal
36       year 2000.
37        (l) In addition to the other purposes for which expenditures may be
38       made by the legislative coordinating council from the legislative coordi-
39       nating council-operations account of the state general fund for the fiscal
40       year ending June 30, 2000, expenditures shall be made by the legislative
41       coordinating council from the legislative coordinating council-operations
42       account of the state general fund for fiscal year 2000 for an additional
43       amount of per diem compensation equal to the amount required to pro-

  1       vide, along with the amount of per diem compensation otherwise payable,
  2       an aggregate amount of compensation of $74.58 per calendar day for each
  3       member of the legislative coordinating council for any calendar day oc-
  4       curring on or after June 13, 1999, for which per diem compensation is
  5       payable from appropriations for the legislative coordinating council under
  6       K.S.A. 46-1209 and amendments thereto to such member as provided in
  7       K.S.A. 75-3212 and amendments thereto at the rate prescribed by sub-
  8       section (a) of K.S.A. 46-137a and amendments thereto: Provided, That
  9       expenditures for such purposes shall be made in the same manner and
10       at the same times that per diem compensation is payable to such members
11       of the legislative coordinating council for the biweekly pay periods for
12       which such per diem compensation is payable for calendar days occurring
13       on or after June 13, 1999, and which are chargeable to fiscal year 2000.
14        (m) In addition to the other purposes for which expenditures may be
15       made by the division of post audit from the operations (including legis-
16       lative post audit committee) account of the state general fund for the
17       fiscal year ending June 30, 2000, expenditures shall be made by the di-
18       vision of post audit from the operations (including legislative post audit
19       committee) account of the state general fund for fiscal year 2000 (1) for
20       an additional amount of per diem compensation equal to the amount
21       required to provide, along with the amount of per diem compensation
22       otherwise payable, an aggregate amount of compensation of $74.58 per
23       calendar day for each member of the legislative post audit committee for
24       any calendar day occurring on or after June 13, 1999, for which per diem
25       compensation is payable from appropriations for the division of post audit
26       under K.S.A. 46-1104 and amendments thereto to such member as pro-
27       vided in K.S.A. 75-3212 and amendments thereto at the rate prescribed
28       by subsection (a) of K.S.A. 46-137a and amendments thereto, and (2) for
29       an additional amount of per diem compensation equal to the amount
30       required to provide, along with the amount of per diem compensation
31       otherwise payable, an aggregate amount of compensation of $74.58 per
32       calendar day for each member of the contract audit committee for any
33       calendar day occurring on or after June 13, 1999, for which per diem
34       compensation is payable from appropriations for the division of post audit
35       under K.S.A. 46-1120 and amendments thereto to such member as pro-
36       vided in K.S.A. 75-3223 and amendments thereto at the rate prescribed
37       by subsection (a) of K.S.A. 46-137a and amendments thereto: Provided,
38       That expenditures for such purposes shall be made in the same manner
39       and at the same times that per diem compensation is payable to such
40       members of the legislative post audit committee or contract audit com-
41       mittee for the biweekly pay periods for which such per diem compensa-
42       tion is payable for calendar days occurring on or after June 13, 1999, and
43       which are chargeable to fiscal year 2000.

  1        (n) In addition to the other purposes for which expenditures may be
  2       made by the judicial branch from the judiciary operations account of the
  3       state general fund for the fiscal year ending June 30, 2000, expenditures
  4       shall be made by the judicial branch from the judiciary operations account
  5       of the state general fund for fiscal year 2000 (1) for an additional amount
  6       of per diem compensation equal to the amount required to provide, along
  7       with the amount of per diem compensation otherwise payable, an aggre-
  8       gate amount of compensation of $74.58 per calendar day for each mem-
  9       ber of the advisory council on dispute resolution for any calendar day
10       occurring on or after June 13, 1999, for which per diem compensation is
11       payable to such member of the advisory council on dispute resolution
12       under K.S.A. 5-505 and amendments thereto who is entitled, in accord-
13       ance with subsection (e) of K.S.A. 75-3223 and amendments thereto, to
14       receive such per diem compensation as provided in K.S.A. 75-3212 and
15       amendments thereto at the rate prescribed by subsection (a) of K.S.A.
16       46-137a and amendments thereto; and (2) for an additional amount of
17       per diem compensation equal to the amount required to provide, along
18       with the amount of per diem compensation otherwise payable, an aggre-
19       gate amount of compensation of $74.58 per calendar day for each retired
20       justice or judge who performs judicial service or duties under K.S.A. 20-
21       2616 and amendments thereto for each calendar day occurring on or after
22       June 13, 1999, for which per diem compensation is payable to such retired
23       justice or judge under K.S.A. 20-2616 and amendments thereto: Pro-
24       vided, That expenditures for such purposes shall be made in the same
25       manner and at the same times that per diem compensation is payable to
26       such members of the advisory council on dispute resolution or to such
27       retired justices or judges for the biweekly pay periods for which such per
28       diem compensation for calendar days occurring on or after June 13, 1999,
29       is payable and which are chargeable to fiscal year 2000.
30        (o) In addition to the other purposes for which expenditures may be
31       made by the judicial council from the operating expenditures account of
32       the state general fund for the fiscal year ending June 30, 2000, expendi-
33       tures shall be made by the judicial council from the operating expendi-
34       tures account of the state general fund for fiscal year 2000 for an addi-
35       tional amount of per diem compensation equal to the amount required
36       to provide, along with the amount of per diem compensation otherwise
37       payable, an aggregate amount of compensation of $74.58 per calendar
38       day for each member of the judicial council and for each regularly ap-
39       pointed member of a special committee of the judicial council who is not
40       a member of the judicial council for any calendar day occurring on or
41       after June 13, 1999, for which per diem compensation is payable to such
42       member of the judicial council or a special committee thereof under
43       K.S.A. 20-2206 and amendments thereto at the rate of compensation in

  1       accordance with K.S.A. 75-3212 and amendments thereto at the rate pre-
  2       scribed by subsection (a) of K.S.A. 46-137a and amendments thereto:
  3       Provided, That expenditures for such purposes shall be made in the same
  4       manner and at the same times that per diem compensation is payable to
  5       such members of the judicial council or special committees thereof for
  6       the biweekly pay periods for which such per diem compensation for cal-
  7       endar days occurring on or after June 13, 1999, is payable and which are
  8       chargeable to fiscal year 2000.
  9        Sec. 49. Appeals to exceed position limitations. (a) The limitations im-
10       posed by this act on the number of full-time and regular part-time posi-
11       tions equated to full-time, excluding seasonal and temporary positions,
12       paid from appropriations for the fiscal year ending June 30, 1999, made
13       in this act or in any appropriation act of the 1998 regular session of the
14       legislature or in any other appropriation act of the 1999 regular session
15       of the legislature may be exceeded upon approval of the state finance
16       council.
17        (b) The limitations imposed by this act on the number of full-time and
18       regular part-time positions equated to full-time, excluding seasonal and
19       temporary positions, paid from appropriations for the fiscal year ending
20       June 30, 2000, made in this act or in any other appropriation act of the
21       1999 regular session of the legislature may be exceeded upon approval of
22       the state finance council.
23        Sec. 50. Appeals to exceed expenditure limitations. Upon written ap-
24       plication to the governor and approval of the state finance council, ex-
25       penditures from special revenue funds may exceed the amounts specified
26       in this act.
27        Sec. 51. Savings. (a) Any unencumbered balance as of June 30, 1999,
28       in any special revenue fund, or account thereof, of any state agency named
29       in this act which is not otherwise specifically appropriated or limited by
30       this or other appropriation act of the 2000 regular session of the legisla-
31       ture, is hereby appropriated for the fiscal year ending June 30, 2000, for
32       the same use and purpose as the same was heretofore appropriated.
33        (b) Any unencumbered balance in any special revenue fund, or account
34       thereof, of any state agency named in section 22 of 1999 Senate Bill No.
35       325 which is not otherwise specifically appropriated or limited for fiscal
36       year 2001 by this or other appropriation act of the 1999 or 2000 regular
37       session of the legislature, is hereby appropriated for fiscal year 2001 for
38       the same use and purpose as the same was heretofore appropriated.
39        Sec. 52. Federal grants. (a) Each federal grant or other federal receipt
40       which is received by a state agency named in this act and which is not
41       otherwise appropriated to that state agency by this or other appropriation
42       act of the 1999 regular session of the legislature, is hereby appropriated
43       for the fiscal year ending June 30, 2000, for that state agency for the

  1       purpose set forth in such federal grant or receipt, except that no expend-
  2       iture shall be made from and no obligation shall be incurred against any
  3       such federal grant or other federal receipt, which has not been previously
  4       appropriated or reappropriated or approved for expenditure by the gov-
  5       ernor, until the governor has authorized the state agency to make ex-
  6       penditures therefrom.
  7        (b) Each federal grant or other federal receipt which is received by a
  8       state agency named in section 22 of 1999 Senate Bill No. 325 and which
  9       is not otherwise appropriated to that state agency for fiscal year 2001 by
10       this or other appropriation act of the 1999 or 2000 regular session of the
11       legislature, is hereby appropriated for fiscal year 2001 for that state agency
12       for the purpose set forth in such federal grant or receipt, except that no
13       expenditure shall be made from and no obligation shall be incurred
14       against any such federal grant or other federal receipt, which has not been
15       previously appropriated or reappropriated or approved for expenditure
16       by the governor, for fiscal year 2001, until the governor has authorized
17       the state agency to make expenditures from such federal grant or other
18       federal receipt for fiscal year 2001.
19        Sec. 53. Any transfers of money during the fiscal year ending June 30,
20       2000, from any special revenue fund of any state agency named in this
21       act to the audit services fund of the division of post audit under K.S.A.
22       46-1121 and amendments thereto shall be in addition to any expenditure
23       limitation imposed on any such fund for the fiscal year ending June 30,
24       2000.
25        Sec. 54. Any correctional institutions building fund appropriation here-
26       tofore appropriated to any state agency named in this or other appropri-
27       ation act of the 1999 regular session of the legislature, and having an
28       unencumbered balance as of June 30, 1999, in excess of $100 is hereby
29       reappropriated for the fiscal year ending June 30, 2000, for the same uses
30       and purposes as originally appropriated unless specific provision is made
31       for lapsing such appropriation.
32        Sec. 55. Any Kansas educational building fund appropriation heretofore
33       appropriated to any institution named in this or other appropriation act
34       of the 1999 regular session of the legislature and having an unencumbered
35       balance as of June 30, 1999, in excess of $100 is hereby reappropriated
36       for the fiscal year ending June 30, 2000, for the same use and purpose as
37       originally appropriated, unless specific provision is made for lapsing such
38       appropriation.
39        Sec. 56. Any state institutions building fund appropriation heretofore
40       appropriated to any state agency named in this or other appropriation act
41       of the 1999 regular session of the legislature and having an unencumbered
42       balance as of June 30, 1999, in excess of $100 is hereby reappropriated
43       for the fiscal year ending June 30, 2000, for the same use and purpose as

  1       originally appropriated, unless specific provision is made for lapsing such
  2       appropriation.
  3        Sec. 57. This act shall take effect and be in force from and after its
  4       publication in the Kansas register.
