  9             AN  ACT concerning juvenile offenders; relating to implementation of
10             juvenile orders of disposition.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) With regard to an order of disposition as provided pur-
14       suant to K.S.A. 38-1563 and amendments thereto following a dispositional
15       hearing, the secretary of social and rehabilitation services, or the secre-
16       tary's designee, shall be responsible for knowing the particulars of the
17       judge's order of disposition. The interpreting, directing, monitoring and
18       implementation of the order of disposition shall remain with the secretary.
19       The secretary may delegate the implementation of the order of disposi-
20       tion to a private contractor.
21             (b) If the order of disposition has been delegated to a private con-
22       tractor, the secretary or the secretary's designee shall remain responsible
23       for each child in custody and remain involved in the implementation of
24       the order of disposition by monitoring the private contractor. The sec-
25       retary shall report to the court as to the extent and effectiveness of the
26       private contractor in the implementation of the order of disposition. The
27       private contractor shall be present before the court as a resource to the
28       secretary or the secretary's designee.
29        Sec.  2. This act shall take effect and be in force from and after its
30       publication in the statute book.
