  9             AN  ACT relating to driver licenses; concerning parent or guardian taught
10             driver education courses.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) A driver education course conducted by the parent or
14       legal guardian of a person who is required to complete an approved course
15       in driver training to obtain a restricted class C driver's license, under the
16       provisions of K.S.A. 8-237, and amendments thereto, shall be approved
17       by the director of the division of vehicles in accordance with the provisions
18       of this section.
19             (b) Any parent or guardian conducting such driver education course:
20             (1) Shall be a holder of a valid Kansas driver's license;
21             (2) shall not have been convicted under K.S.A. 8-1567 or 21-3405,
22       and amendments thereto; and
23             (3) shall not be disabled because of mental illness.
24             (c) The division shall not approve a course unless it determines that
25       the course materials are at least equal to those materials required in a
26       course approved by the state board of education, except that the division
27       shall not require that:
28             (1) The classroom instruction be provided in a room with particular
29       characteristics or equipment; and
30             (2) the motor vehicle used for the behind-the-wheel instruction have
31       equipment other than the equipment otherwise required by law for op-
32       eration of the motor vehicle on a highway while the motor vehicle is not
33       being used for driver training.
34             (d) Completion of a driver education course approved under this sec-
35       tion shall have the same effect as completion of a driver education course
36       approved by the state board of education.
37             (e) The secretary of the department of revenue shall adopt rules and
38       regulations establishing:
39             (1) The minimum number of hours required for classroom instruc-
40       tion and behind-the-wheel instruction;
41             (2) the procedures for approving a driver education course under this
42       section, including criteria for course materials; and
43             (3) the method the student driver submits proof of completion of a
44       driver education course under this section.
45             (f) The division shall maintain and provide upon request a list of ap-
46       proved parent or guardian driver education courses.
47        Sec.  2. This act shall take effect and be in force from and after its
48       publication in the statute book.
