10             AN  ACT concerning civil procedure; relating to venue; amending K.S.A.
11             60-612 and repealing the existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 60-612 is hereby amended to read as follows: 60-
15       612. (a) Without changing venue, a judge may conduct any hearing or
16       nonjury trial in any county agreed upon by all parties who are not in
17       default.
18             (b) If the court finds on application motion of any party, that the
19       county where an action was filed does not have a courtroom which con-
20       forms to section 11 of the Americans with disabilities act accessibility
21       guidelines for buildings and facilities (ADAAG) adopted by 28 CFR
22       36.406 and incorporated in appendix A thereto, and amendments thereto
23       as in effect on July 1, 1999, and that such failure to conform would
24       prohibit or limit the participation of a person material to the proceeding,
25       the judge, without changing venue, shall may conduct any hearing or
26       trial in any county with an accessible courtroom.
27             (c) If the court finds, on application motion of any person at least 20
28       days before the hearing or trial, that the county where an action was filed
29       does not have a courtroom which conforms to section 11 of the Americans
30       with disabilities act accessibility guidelines for buildings and facilities
31       (ADAAG) adopted by 28 CFR 36.406 and incorporated in appendix A
32       thereto, and amendments thereto as in effect on July 1, 1999, and that
33       such failure to conform would prohibit or limit the attendance of any
34       person, the judge, without changing venue, may conduct the hearing or
35       trial in any county with an accessible courtroom. Notice of the change of
36       the location shall be given to the parties at least 10 days prior to the date
37       of the first proceeding at the alternate location.  
38       Sec.  2. K.S.A. 60-612 is hereby repealed.
39        Sec.  3. This act shall take effect and be in force from and after its
40       publication in the statute book.
