  9             AN  ACT concerning the university of Kansas school of medicine; relating
10             to the medical student loan act; concerning satisfaction of loan recip-
11             ients service obligation; amending K.S.A. 76-384 and repealing the
12             existing section.

14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 76-384 is hereby amended to read as follows: 76-
16       384. (a) Upon the selection of a service commitment area for the purposes
17       of satisfying a service obligation under a medical student loan agreement
18       entered into under this act, the person so selecting shall inform the uni-
19       versity of Kansas school of medicine of the service commitment area
20       selected.
21             (b) A person serving in a service commitment area pursuant to any
22       agreement under this act may serve all or part of any commitment in the
23       service commitment area initially selected by such person. If such person
24       moves from one service commitment area to another service commitment
25       area, such person shall notify the university of Kansas school of medicine
26       of such person's change of service commitment area. Service in any such
27       service commitment area shall be deemed to be continuous for the pur-
28       pose of satisfying any agreement entered into under this act.
29             (c) A person receiving a medical student loan under this act, may
30       satisfy the obligation to engage in the full-time practice of medicine and
31       surgery in a service commitment area if the person serves as a full-time
32       faculty member of the university of Kansas school of medicine in general
33       internal medicine, general pediatrics, emergency medicine, family medi-
34       cine or family practice and serves two years for each one year of such
35       obligation, or the equivalent thereof on a two-for-one basis, except that,
36       at the time any person commences satisfying such service obligation as a
37       full-time faculty member pursuant to this subsection, the number of per-
38       sons satisfying service commitments or service obligations, pursuant to
39       agreements under K.S.A. 76-374 and amendments thereto or the medical
40       student loan act, as full-time faculty members pursuant to this subsection
41       shall not exceed the number equal to 25% of the total number of full-
42       time faculty members of the university of Kansas school of medicine in
43       general internal medicine, general pediatrics, emergency medicine, family
44       medicine or family practice.
45             (d) A person may satisfy the obligation to engage in the full-time
46       practice of medicine and surgery in a service commitment area by per-
47       forming at least 100 hours per month of on-site primary care as defined
48       in K.S.A. 76-374 and amendments thereto at a medical facility operated
49       by a local health department or nonprofit organization in this state serving
50       medically indigent persons. As used in this subsection, "medically indi-
51       gent" means a person: (1) Who is unable to secure health care because
52       of inability to pay for all or a part of the costs thereof due to inadequate
53       personal resources, being uninsured, being underinsured, being ineligible
54       for governmental health benefits; or (2) who is eligible for governmental
55       benefits but is unable to obtain medical services. 
56       Sec.  2. K.S.A. 76-384 is hereby repealed.
57        Sec.  3. This act shall take effect and be in force from and after its
58       publication in the statute book.
