  9             AN  ACT concerning the university of Kansas school of medicine; estab-
10             lishing the Kansas urban underserved medical residency bridging pro-
11             gram; prescribing guidelines and limitations therefor; authorizing cer-
12             tain loans and agreements thereunder.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. (a) There is hereby established the Kansas urban under-
16       served medical residency bridging program which shall be developed and
17       implemented in order to provide encouragement, opportunities and in-
18       centives for persons in primary care residency training programs in gen-
19       eral pediatrics, general internal medicine or family practice, which are
20       operated by or affiliated with the university of Kansas school of medicine,
21       to locate their medical practice in underserved urban Kansas areas upon
22       completion of such residency training.
23             (b) Subject to the provisions of appropriation acts, the university of
24       Kansas school of medicine may enter into urban residency bridging loan
25       agreements, in accordance with the provisions of this section, (1) with
26       any person who has completed the first year of a primary care residency
27       training program in general pediatrics, general internal medicine or family
28       practice, which is operated by or affiliated with the university of Kansas
29       school of medicine or other such primary care residency training program
30       which is operated in Kansas and approved by the state board of healing
31       arts and (2) with a person under subsection (i).
32             (c) Subject to the provisions of appropriation acts, each person en-
33       tering into an urban residency bridging loan agreement under this section
34       shall receive a payment of $10,000 each year of primary care residency
35       training, or any part of a year of such training, after the date that the
36       urban residency bridging loan agreement is entered into by the resident
37       and the university of Kansas school of medicine.
38             (d) Each urban residency bridging loan agreement shall require that
39       the person receiving the loan:
40             (1) Complete the residency training program;
41             (2) engage in the full-time practice of medicine and surgery for a
42       period of three years in a medical care facility or institution, approved for
43       participation pursuant to subsection (e), in Sedgwick or Wyandotte county

  1       which primarily serves indigent patients;
  2             (3) commence such full-time practice of medicine and surgery within
  3       90 days after completing the primary care residency training program;
  4       and
  5             (4) upon failure to satisfy the obligation to engage in the full-time
  6       practice of medicine and surgery in accordance with the provisions of the
  7       urban residency bridging loan agreement and this section, the person
  8       receiving the loan under this section shall repay to the university of Kansas
  9       school of medicine, within 90 days of such failure, the amount equal to
10       the amount of money received by such person from the university of
11       Kansas school of medicine, less credits earned, under such agreement
12       plus interest at the annual rate of 15% from the date such money was
13       received.
14             (e) On or before December 31 in each year, the chancellor of the
15       university of Kansas, or the designee of the chancellor, shall prepare a
16       list of medical care facilities or institutions located in Sedgwick or Wy-
17       andotte county which the chancellor, or designee of the chancellor, de-
18       termines to be critically underserved medical care facilities or institutions
19       serving primarily indigent patient populations which qualify for partici-
20       pation by a medical resident to satisfy such medical resident's service
21       obligation under this section.
22             (f) An obligation to engage in the practice of medicine and surgery
23       in accordance with the provisions of an urban residency bridging loan
24       agreement and this section shall be postponed during (1) any period of
25       temporary medical disability during which the person obligated is unable
26       to practice medicine and surgery because of such medical disability, or
27       (2) any other period of postponement agreed to or determined in ac-
28       cordance with criteria agreed to in the practice commitment agreement.
29             (g) An obligation to engage in the practice of medicine and surgery
30       in accordance with the provisions of an urban residency bridging loan
31       agreement and this section shall be satisfied: (1) If the obligation to en-
32       gage in the practice of medicine and surgery in accordance with such
33       agreement has been completed, (2) if the person obligated dies, or (3) if,
34       because of permanent physical disability, the person obligated is unable
35       to practice medicine and surgery.
36             (h) The university of Kansas school of medicine may adopt additional
37       provisions, requirements or conditions for participation in the Kansas ur-
38       ban underserved medical residency bridging program as are practicable
39       and appropriate to accomplish the purposes of the program or as may be
40       required for the implementation or administration of the program and,
41       in any case, as are not inconsistent with the provisions of this section or
42       the provisions of the appropriation acts.

  1        Sec.  2. This act shall take effect and be in force from and after its
  2       publication in the statute book.
