  9             AN  ACT relating to public transportation; providing for access to certain
10             public accommodations; penalties.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) A public accommodation shall not prohibit or restrict
14       any public transportation bus from full access to any parking lot of such
15       public accommodation, if the public transportation vehicle is able to enter
16       and leave the parking lot as built.
17             (b) Violation of subsection (a) is an unclassified misdemeanor pub-
18       lishable by a fine of not less than $500 nor more than $5,000.
19             (c) As used in this section:
20             (1) "Public accommodation" means any business or service which of-
21       fers goods or services to the general public or who leases retail, manu-
22       facturing or office space to such businesses or services; and
23             (2) "public transportation bus" means a bus as defined in K.S.A. 8-
24       1406, and amendments thereto, which is accessible to elderly persons,
25       persons with disabilities and the general public.
26        Sec.  2. This act shall take effect and be in force from and after its
27       publication in the statute book.
