  9             AN  ACT concerning taxation; relating to real estate sales validation ques-
10             tionnaires; amending K.S.A. 79-1437e and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 79-1437e is hereby amended to read as follows: 79-
15       1437e. (a) The real estate sales validation questionnaire required by this
16       act shall not apply to transfers of title:
17             (1) Recorded prior to the effective date of this act;
18             (2) made solely for the purpose of securing or releasing security for
19       a debt or other obligation;
20             (3) made for the purpose of confirming, correcting, modifying or sup-
21       plementing a deed previously recorded, and without additional
22       consideration;
23             (4) by way of gift, donation or contribution stated in the deed or other
24       instrument;
25             (5) to cemetery lots;
26             (6) by leases and transfers of severed mineral interests;
27             (7) to a trust, and without consideration;
28             (8) resulting from a divorce settlement where one party transfers in-
29       terest in property to the other;
30             (9) made solely for the purpose of creating a joint tenancy or tenancy
31       in common;
32             (10) by way of a sheriff's deed;
33             (11) by way of a deed which has been in escrow for longer than five
34       years;
35             (12) by way of a quit claim deed filed for the purpose of clearing title
36       encumbrances;
37             (13) when title is transferred to convey right-of-way or pursuant to
38       eminent domain;
39             (14) made by a guardian, executor, administrator, conservator or trus-
40       tee of an estate pursuant to judicial order; or
41             (15) when title is transferred due to repossession.
42             (b) When a real estate sales validation questionnaire is not required
43       due to one or more of the exemptions provided in subsection (a), the
44       exemption shall be clearly stated on the document being filed. 
45       Sec.  2. K.S.A. 79-1437e is hereby repealed.
46        Sec.  3. This act shall take effect and be in force from and after its
47       publication in the statute book.
