12             AN  ACT concerning the state board of regents; relating to the member-
13             ship thereof; amending K.S.A. 1998 Supp. 74-3201 and repealing the
14             existing section.

16       Be it enacted by the Legislature of the State of Kansas:
17             Section  1. K.S.A. 1998 Supp. 74-3201 is hereby amended to read as
18       follows: 74-3201.(a) (1) There is hereby created a state board to be known
19       as the board of regents. The board shall be composed of nine members
20       who shall be residents of the state and who shall be appointed by the
21       governor subject to confirmation by the senate as provided in K.S.A. 75-
22       4315b, and amendments thereto. Except as provided by K.S.A. 1998
23       Supp. 46-2601, and amendments thereto, no person appointed to the
24       board shall exercise any power, duty or function as a member of the board
25       until confirmed by the senate. Each member shall hold office for a term
26       of four years, and until a successor is appointed and confirmed. Terms of
27       members shall expire on January 15. All members of the board of regents
28       shall be selected from among the members of the two political parties
29       casting the highest and second highest number of votes respectively for
30       secretary of state at the last preceding general election at which a sec-
31       retary of state was elected. At no time shall more than five members of
32       the board of regents be members of the same political party. The mem-
33       bers of the board of regents shall meet and organize annually by electing
34       one member as chairperson.
35             (2) The provisions of this subsection are subject to the provisions of
36       subsection (b).
37             (b) No alumnus of any college or university, other than an alumnus
38       of a state educational institution not presently represented on the board
39       of regents, or any other individual with the exception of the member serv-
40       ing as chairperson of the board on the effective date of this act, may be
41       appointed, or reappointed, to the board of regents, until such time as each
42       state educational institution has at least one alumni member of the board
43       of regents; after which time, any state educational institution which then
44       has more than one alumni member of the board, shall not have an addi-
45       tional alumni member appointed to the board, until such time as no state
46       educational institution has more than two alumni members of the board.
47       Thereafter, no state educational institution shall have more than two of
48       its alumni as members of the board. 
49       Sec.  2. K.S.A. 1998 Supp. 74-3201 is hereby repealed.
50        Sec.  3. This act shall take effect and be in force from and after its
51       publication in the statute book.
