10             AN  ACT concerning state governmental ethics; relating to lobbyists and
11             reports filed thereby; amending K.S.A. 1999 Supp. 46-269 and re-
12             pealing the existing section.

14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 1999 Supp. 46-269 is hereby amended to read as
16       follows: 46-269. (a) Each report under K.S.A. 46-268, and amendments
17       thereto, shall disclose the following:
18             (a) (1) The full name and address of each person who has paid com-
19       pensation for lobbying to the lobbyist or has paid for expenses of lobbying
20       by the lobbyist during the period reported.;
21             (b) (2) the aggregate amount or value of all expenditures made, ex-
22       cept for expenses of general office overhead, by the lobbyist or by the
23       lobbyist's employer for or in direct relation to lobbying during the re-
24       porting period, if such expenditures exceed $100. Individual expenditures
25       of less than $2 shall not be required to be reported under this subsection.
26       Every lobbyist shall keep detailed accounts of all expenditures required
27       to be reported pursuant to K.S.A. 46-268, and amendments thereto. Such
28       expenditures shall be reported according to the following categories of
29       expenditures:
30             (1) (A) Food and beverages provided as hospitality;
31             (2) (B) entertainment, gifts, honoraria or payments;
32             (3) (C) mass media communications;
33             (4) (D) recreation provided as hospitality;
34             (5) (E) communications for the purpose of influencing legislative or
35       executive action; and
36             (6) (F) all other reportable expenditures made in the performance of
37       services as a lobbyist.With regard to expenditures for entertainment or
38       hospitality which is primarily recreation, food and beverages, only
39       amounts expended on a state officer or employee or on such officer or
40       employee's spouse shall be considered to be for or in direct relation to
41       lobbying. Notwithstanding the requirements of this subsection and sub-
42       section (c), no lobbyist shall be responsible to report any expenditure by
43       the lobbyist's employer of which such person has no knowledge.; and

  1             (3) in addition to the aggregate amount or value of expenditures re-
  2       ported under paragraph (2), an estimate of the amount or value of such
  3       expenditures made on each individual state officer or employee.
  4             (c) (b) Whenever an individual lobbyist contributes to a single special
  5       event, such lobbyist shall report only the aggregate amount or value of
  6       the expenditure contributed by such lobbyist.
  7             (d) (c) Whenever more than one lobbyist is employed by a single
  8       employer, the reports required by this section relating to such employer
  9       shall be made by only one such lobbyist and that lobbyist shall be the
10       lobbyist who is most directly connected with the particular expenditure
11       or gift, honoraria or payment. No expenditure or gift, honoraria or pay-
12       ment required to be reported by this section shall be reported by more
13       than one lobbyist.
14             (e) (d) All accounts, records and documents of the lobbyist which
15       relate to every expenditure reported or which should have been reported
16       shall be maintained and preserved by the lobbyist for a period of five
17       years from the date of the filing of such report or statement and may be
18       inspected under conditions determined by the commission. 
19       Sec.  2. K.S.A. 1999 Supp. 46-269 is hereby repealed.
20        Sec.  3. This act shall take effect and be in force from and after its
21       publication in the statute book.
