  9             AN  ACT concerning firearms and firearms dealers; relating to the reg-
10             ulation thereof; relating to the limitation on certain civil actions relating
11             thereto.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. (a) The legislature finds as a matter of public policy and
15       fact that it is necessary to provide statewide uniform standards for the
16       regulation of firearms and finds it necessary to occupy the field of regu-
17       lation of firearms to ensure that honest, law-abiding persons are not sub-
18       jectively or arbitrarily denied their rights under the laws of this state.
19             (b) The legislature finds that the lawful design, marketing, manufac-
20       ture or sale of firearms or ammunition to the public is not an unreasonably
21       dangerous activity and does not constitute a nuisance.
22             Sec.  2. (a) No city or county shall regulate in any manner gun shows
23       or the possession, ownership, transport, carrying, transfer, sale, purchase,
24       licensing or registration of firearms, components of firearms, firearms
25       dealers or dealers in firearms components.
26             (b) The power to bring suit and right to recover against any firearms
27       or ammunition manufacturer, trade association, or dealer by or on behalf
28       of the state or any political subdivision of the state for damages, abate-
29       ment, or injunctive relief resulting from or relating to the lawful design,
30       manufacture, marketing, or sale of firearms or ammunition to the public
31       shall be reserved exclusively to the state. This subsection shall not prohibit
32       a political subdivision from bringing an action against a firearms or am-
33       munition manufacturer or dealer for breach of contract or warranty as to
34       firearms or ammunition purchased by such political subdivision.
35             (c) The provisions of this act shall apply to any action pending on or
36       brought on or after the effective date this act.
37        Sec.  3. This act shall take effect and be in force from and after its
38       publication in the statute book.
