12             AN  ACT concerning public works projects for state agencies; prescribing
13             payment of minimum wages for work thereon and preferences for
14             certain employees to work thereon.

16       Be it enacted by the Legislature of the State of Kansas:
17             Section  1. (a) Each contract entered into by any state agency for any
18       nonfederal aid, public works project shall be based on bid or contract
19       specifications prescribing and requiring that employees of any contractor
20       or subcontractor shall be paid not less than the hourly wages, including
21       fringe benefits, paid to corresponding classes of laborers and mechanics
22       employed on similar projects in the county where the project is to be
23       performed. Such minimum wage shall be the wage paid to the majority
24       of the laborers or mechanics, unless the same wages are not paid to a
25       majority, in which case the minimum wage shall be the average wages
26       paid, weighted by the total employed in the classification. In the alter-
27       native, the minimum wage shall be that determined under federal law
28       which would be required to be paid on federally funded projects at the
29       location of the public works project.
30             (b) Employees employed by contractors or subcontractors in the ex-
31       ecution of any nonfederal aid, public works project contract with any state
32       agency shall be paid not less than the wages as determined pursuant to
33       subsection (a).
34             (c) First preference for contracts for public works projects owned by
35       or built for any state agency shall be contractors employing exclusively
36       Kansas resident employees.
37        Sec.  2. This act shall take effect and be in force from and after its
38       publication in the statute book.
