  9             AN  ACT concerning crimes and punishment; endangering a child;
10             amending K.S.A. 21-3608 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. K.S.A. 21-3608 is hereby amended to read as follows: 21-
14       3608. (a) Endangering a child is intentionally and unreasonably causing
15       or permitting a child under the age of 18 years to be placed in a situation
16       in which the child's life, body or health may be injured or endangered.
17             (b) Nothing in this section shall be construed to mean a child is en-
18       dangered for the sole reason the child's parent or guardian, in good faith,
19       selects and depends upon spiritual means alone through prayer, in ac-
20       cordance with the tenets and practice of a recognized church or religious
21       denomination, for the treatment or cure of disease or remedial care of
22       such child.
23             (c) Endangering a child is:
24             (1) A class A person misdemeanor.;
25             (2) a severity level 5, person felony when done in the commission of,
26       attempt to commit, or flight from a felony crime as defined in the criminal
27       code of this state or in any other statute of this state.  
28       Sec.  2. K.S.A. 21-3608 is hereby repealed.
29        Sec.  3. This act shall take effect and be in force from and after its
30       publication in the statute book.
