  9             AN  ACT concerning crimes and punishments; cheating or defrauding a
10             person primarily engaged in the retail sale of property or services.
11      
12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) Cheating or defrauding a person primarily engaged in
14       the retail sale of property or services is:
15             (1) Intentionally and knowingly possessing, using, uttering, transfer-
16       ring, making, altering, counterfeiting, or reproducing a retail sales receipt
17       or a universal price code label; or
18             (2) intentionally and knowingly possessing 15 or more fraudulent re-
19       ceipts, universal price code labels, or the device that manufactures fraud-
20       ulent receipts or universal price code labels.
21             (b)  (1) Cheating or defrauding a person primarily engaged in the
22       retail sale of property or services as described in subsection (a)(1) is a
23       severity level 9, nonperson felony.
24             (2) Cheating or defrauding a person primarily engaged in the retail
25       sale of property or services as described in subsection (a)(2) is a severity
26       level 8, nonperson felony.
27        Sec.  2. This act shall take effect and be in force from and after its
28       publication in the statute book.
