  9             AN  ACT concerning telecommunications; requiring the establishment of
10             certain base rates for basic telephone service.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) As used in this section:
14             (1) "Basic telephone service" means those services enumerated in the
15       definition of "universal service" in K.S.A. 66-1,187 and amendments
16       thereto.
17             (2) "Commission" means the state corporation commission.
18             (3) "Local exchange carrier" has the meaning provided by K.S.A. 66-
19       1,187 and amendments thereto.
20             (b) The commission shall establish three classes of local exchange
21       carriers based on the total number of customers that each carrier has in
22       all the carrier's local exchange areas in the state. The commission shall
23       establish a base rate for basic telephone service for each such class. Each
24       local exchange carrier shall charge to all customers within all the carrier's
25       local exchange areas in the state the base rate established by the com-
26       mission for the carrier's class.
27        Sec.  2. This act shall take effect and be in force from and after its
28       publication in the statute book.
