  9             AN  ACT concerning crimes and punishments; amending K.S.A. 21-4001
10             and repealing the existing section; also repealing K.S.A. 21-4002.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  4. K.S.A. 21-4001 is hereby amended to read as follows: 21-
14       4001. (a) Eavesdropping Invasion of privacy is knowingly and without
15       lawful authority:
16             (1)  (A) Entering into a private place with intent to listen surrepti-
17       tiously to private conversations or to observe the personal conduct of any
18       other person or persons surreptitiously: (i) Listen to, record, amplify or
19       broadcast any private conversation or sound of any person therein; or (ii)
20       observe, record, amplify or broadcast the personal conduct or visual im-
21       age of any person therein;
22             (2) (B) installing or using, inside or outside, a private place any device
23       for hearing, recording, amplifying or broadcasting sounds any private
24       conversation, sound or visual image originating in such place, which
25       sounds would not ordinarily be audible or,comprehensible or visible out-
26       side such place, without the consent of the person or persons entitled to
27       privacy therein;or
28             (3) (C) Installing or using any device or equipment for the intercep-
29       tion of any telephone, telegraph or other wire communication transmitted
30       by electronic or other private means of communication, without the con-
31       sent of the person in possession or control of the facilities for such wire
32       communication; or
33             (D) intercepting, without the consent of the sender or receiver, a mes-
34       sage transmitted by electronic or other private means of communication;
35       or
36             (2) disclosing, displaying, distributing, broadcasting or publishing,
37       without consent of the person or persons entitled to privacy, any com-
38       munication, visual image, sound recording, sound amplification, visual
39       image or visual recording made in violation of subsection (a)(1).
40             (b) A As used in this section, "private place" within the meaning of
41       this section is means a place where one may reasonably expect to be safe
42       from uninvited intrusion or surveillance, but does not include a place to
43       which the public has lawful access.
44             (c) It shall not be unlawful for This section does not apply to:
45             (1) Recording conversations, sounds or visual images for security pur-
46       poses if notice of the recording is clearly posted at the location; or
47             (2) interception, disclosure or use of a communication in the normal
48       course of employment by any of the following whose facilities are used in
49       the transmission of that communication and who is engaging in an activity
50       incident to the rendition of public utility, internet or cablevision service
51       or to the protection of the rights of property of the public utility, internet
52       service provider or cablevision service provider: (A) An operator of a
53       switchboard, or; (B) any officer, employee, or agent of any public utility
54       providing telephone communications service, whose facilities are used in
55       the transmission of a communication, to intercept, disclose or use that
56       communication in the normal course of employment while engaged in
57       any activity which is incident to the rendition of public utility service or
58       to the protection of the rights of property of such public utility; (C) any
59       internet service provider; or (D) any cablevision service provider.
60             (d) Eavesdropping is a class A nonperson misdemeanor Subsection
61       (a)(1)(D) shall not apply to communications overheard through a regu-
62       larly installed instrument on a telephone party line or on an extension.
63             (e) Invasion of privacy is a level 8, person felony
64       Sec.  5. K.S.A. 21-4001 and 21-4002 are hereby repealed.
65        Sec.  6. This act shall take effect and be in force from and after its
66       publication in the statute book.
