9 AN ACT relating to state finances; concerning biennial budget estimates
10 for state agencies; amending K.S.A. 75-3717 and 75-6701 and repeal-
11 ing the existing sections.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 75-3717 is hereby amended to read as follows: 75-
15 3717. (a) As provided in this section, each state agency listed in subsection
16 (f), not later than October 1 of each year, shall file with the division of
17 the budget its budget estimates for the next fiscal year, and all amend-
18 ments and revisions thereof, except that, in lieu of such annual filing. As
19 provided in this section, each agency not listed in subsection(g) (f), not
20 later than October 1, 1994, of each year and every two years thereafter,
21 shall file budget estimates for the next fiscal year and for the ensuing
22 fiscal year thereafter, and all amendments and revisions thereof. Each
23 state agency listed in subsection (g) may file adjustments to such agency's
24 budget that was approved by the legislature during a prior fiscal year. All
25 such budget estimates shall be in the form provided by the director of
26 the budget. Each agency's budget estimates shall include:
27 (1) A full explanation of the agency's request for any appropriations
28 for the expansion of present services or the addition of new activities,
29 including an estimate of the anticipated expenditures for the next fiscal
30 year and for each of the three ensuing fiscal years which would be re-
31 quired to support each expansion of present services or addition of new
32 services as requested by the state agency; and
33 (2) a listing of all programs of the agency that provide services for
34 children and their families and the following information regarding each
35 such program: Of the amount of the agency's request for appropriations
36 to fund the program, that amount which will be spent on services for
37 children or families with children and the number of children or families
38 with children who are served by the program.
39 (b) At the same time as each state agency submits to the division of
40 the budget a copy of its budget estimate, and all amendments and revi-
41 sions thereof, each such state agency shall submit a copy of such estimate,
42 and all amendments and revisions thereof, directly to the legislative re-
43 search department for legislative use.
44 (c) The director of the budget shall require the agencies to submit a
45 sufficient number of copies of their budget estimates, and all amendments
46 and revisions thereof, to the director's office to satisfy the requirements
47 of such office and one additional copy for legislative use which shall be
48 retained in the division of the budget until the budget of the governor is
49 submitted to the legislature. On or before the day that such budget is
50 submitted to the legislature such legislative use copy, posted to reflect
51 the governor's budget recommendations, shall be submitted to the leg-
52 islative research department for use by the ways and means committee
53 of the senate and the committee on appropriations of the house of rep-
54 resentatives. Following presentation of the governor's budget report to
55 the legislature, the legislative research department may request and shall
56 receive detailed information from the division of the budget on the gov-
57 ernor's budget recommendations.
58 (d) The director of the budget may prepare budget estimates for any
59 state agency failing to file a request.
60 (e) As used in this section, "services for children and their families"
61 includes but is not limited to any of the following services, whether pro-
62 vided directly or made accessible through subsidies or other payments:
63 (1) Financial support for children and families with children or en-
64 forcement of the obligation to support a child or a family with one or
65 more children;
66 (2) prenatal care, health care for children or immunizations for
67 children;
68 (3) mental health or retardation services for children;
69 (4) nutrition for children or families with children or nutritional coun-
70 seling or supplements for pregnant or nursing women;
71 (5) child care, early childhood education or parenting education;
72 (6) licensure or regulation of child care or early childhood education
73 programs;
74 (7) treatment, counseling or other services to preserve families;
75 (8) care, treatment, placement or adoption of children without func-
76 tioning families;
77 (9) services to prevent child abuse and to treat and protect child
78 abuse victims;
79 (10) services for children who are pregnant, substance abusers or oth-
80 erwise involved in high risk behavior;
81 (11) services related to court proceedings involving children; and
82 (12) youth employment services.
83 (f) On a biennial an annual basis, the following state agencies shall
84 file budget estimates under the provisions of subsection (a): Abstracters'
85 board of examiners, behavioral sciences regulatory board, board of ac-
86 countancy, board of examiners in optometry, board of nursing, consumer
87 credit commissioner, Kansas board of barbering, Kansas board of exam-
88 iners in fitting and dispensing of hearing aids, Kansas dental board, Kansas
89 real estate commission, Kansas state board of cosmetology, office of the
90 securities commissioner of Kansas, real estate appraisal board, state bank
91 commissioner, state board of healing arts, state board of mortuary arts,
92 state board of pharmacy, state board of technical professions, state board
93 of veterinary examiners and state department of credit unions Depart-
94 ment of education, department on aging and department of social and
95 rehabilitation services.
96 Sec. 2. K.S.A. 75-6701 is hereby amended to read as follows: 75-
97 6701. (a) On or before each December 4 and on or before each April 4,
98 the director of the budget and the director of the legislative research
99 department shall prepare a joint estimate of revenue to the state general
100 fund for the current fiscal year and the for each of the two ensuing fiscal
101 year years.
102 (b) If prior to final adjournment of any regular session of the legis-
103 lature any law is enacted providing for additional or less revenues to be
104 deposited in the state treasury to the credit of the state general fund, the
105 director of the budget and the director of the legislative research de-
106 partment shall prepare a joint estimate of such revenues.
107 (c) In the event of a disagreement or failure to agree upon a joint
108 estimate of revenue pursuant to subsection (a) or (b), the legislature shall
109 utilize the estimates of the director of the legislative research department
110 and the governor shall utilize the estimates of the director of the budget.
111 Sec. 3. K.S.A. 75-3717 and 75-6701 are hereby repealed.
112 Sec. 4. This act shall take effect and be in force from and after July
113 1, 2000, and its publication in the statute book.
