          10             A RESOLUTION authorizing the Legislative Coordinating Council to
11             intervene in the Shawnee County District Court case, State ex rel.
12             Stovall v. The Kansas Department of Revenue.
13            
14                 WHEREAS, The state legislature has expressed specific public policy
15             in establishing a statewide property tax valuation system; and
16                 WHEREAS, The constitutionality of the statewide system of property
17             tax valuation has been challenged in an action filed by the Kansas Attorney
18             General; and
19                 WHEREAS, Legal action on behalf of the Legislature to ensure the
20             constitutionality of the statewide system of property tax valuation and to
21             uphold the public policy goals expressed therein is desirable; and
22                 WHEREAS, During the legislative session one house of the legislature
23             must pass a resolution authorizing the Legislative Coordinating Council
24             to file or to intervene in a lawsuit, pursuant to K.S.A. 46-1224: Now,
25             therefore,
26                 Be it resolved by the Senate of the State of Kansas: That the Kansas
27             attorney general move for dismissal in the Shawnee County District Court
28             case, styled State ex rel. Stovall v. The Kansas Department of Revenue,
29             case number 92 CV 796;
30                 Be it further resolved: That the Legislative Coordinating Council is
31             authorized to intervene in the Shawnee County District Court case, styled
32             State ex rel. Stovall v. The Kansas Department of Revenue, case number
33             92 CV 796 in the event that the aforementioned motion for dismissal is
34             denied. The intervention shall be assisted by the secretary of agriculture,
35             the chairperson of the use-value advisory committee and a person des-
36             ignated by the chairperson; and
37                 Be it further resolved: That the Secretary of the Senate be directed
38             to provide an enrolled copy of this resolution to the Chairperson of the
39             Legislative Coordinating Council.
